Resolution 230 r- I RESOLUTION NO.230 OONSENTING 'f0 INSTImTING OF PROCEEDINGS FOR ANNEXATION OF TERRITORY 'l'0 THE CITY OF GILROY. IHEREAS, it bas been represented to the Mayor and Common Counoil ot the City ot Gilroy that proceedings will be instituted under the provisions of an aot of the legislature of the State of CaliforDia, enti tIed: "AN ACT TO PROVIDE FOR THE ALTERATION OF TlIE BOUNPARIES OF AND FOR THE ANNEXATION OF rr.ERRITORY TO MUNICIPAL CORPORATIONS,FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART THEREOF,AND FOR TEE DISTRICTING,GOVERNMENr AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRI!!RY- approved ~une llth,1913, and all acts amendatory thereof and supplemantary thereto, whioh said aot is designated as referred to as the"ANNEXATION ACT OF 1913" for the annexation to th~- City of Gilroy 01 'he following desoribed territory adjaoent thereto, to-wit: All that oertain property looated in the County of Santa Clara,State of California,and being more partioularly desoribed as follows: "BEING a part of Ranoh Lots 16 and 20 as shown on Map No.7 aoc- ompanying the report of the Referees in the Las Animas Partition 6uit,Aotion No.5536, had in the Superior Court of the State ot Calitornia, in an tor the County of Santa Clara, and more particularly described as follows: Beginning at the interseotion of the westerly line ot Prinoevalle with the Southerly line of TUird Street ,being tit the presently westerly Corporate Limits of the City of ~ilroy, and running thenoe along the southerly line of Third Street to the Westerly line of Miller Avenue;tbenoe westerly across Miller Avenue to the point of interseotion or the westerly line of Miller Avenue with the southerly line of Third Street as shown on Map entitled "Traot NO.506, Castlewood Park Unit No.1" as recorded in Book 18,at page 40, of Maps,Official Records or Santa Clara County;thenoe along the southerly line of Third Street N. 890 13' 30. W. 150 feet to the westerly line or said Castlewood Park;thenoe along the westerly line of Ca~lewood Park 6. 00 46' 30. W. to its intersection with the southerly line of Fifth Street;thenoe easterly along the southerly line of Fifth Street to the westerly line of PriA_c~valle Street;thenoe northerly along the westerly line of Pronoeva11e Street to the southerly line of Third Street and the point ot beginning." and, WHEREAS, the said act of the legislature above set forth requires the consent or the 1881s1at1ve body or the City to which it is pro-posed to annex territory betore any prooeedings are cOmDBnced 1136 pursuant to the provisions of that act, and WHEREAS, the Common Counoil of the City of Gilroy is willing to consent to the institution of suoh proceedings; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common Counoil of the City of Gilroy does hereby oonsent to the. institution of pro- oeedings pursuant to the provisions of the said enactment of the State Legislature for the annexation of the territory hereinbefore described to the said City of Gilroy, such oonsent, however, not to be oonstrued to be a consent to the said annexation.
