RESOLUTION NO. 232
RESOLUTION OF INTENTION TO CALL A SPECIAL ELECTION IN THE
TERRITORY PROPOSED TO BE ANNEXED TO THE CITY OF GIlROY.
\mEREAS a notioe of intention to oiroulate a petition for the
changing of the boundaries of the City of Gilroy by the annexation
of certain territory adjaoent thereto has been pUblished by the
proponents thereof in the manner required in the Eleotions Code of
the State of California, and in aooordance with the provisions of
Article 2 of Chapter 1 of Part~ 2 of Divison 2 of Title 4 ot the
Government Code, generally referred to and designated as "Annexation
Act of 1913", and whioh sa:tclcnotioe contains a desoription of the
territory proposed to be annexed to the City of Gilroy, said des-
oription being the same as that hereinafter oontained,and
~T.rnREAS the Common Counoil of the City of &tlroy has here-
tofore oonsented to the ciroulation of the said petition and the
taking of annexation prooeedings, and
WHEREAS within ten days of the date of the publishing of said
notice proponents did file a oopy of the notice, aocompanying
stat ement and an affidavit of the publishing of the notice with
the City Clerk 0 l' the Ci ty 0 f Gilroy, and did also thereafter and
after the expiration of 21 days after the publioation of the notioe
and statement oause to be oiroulated among the voters within the
area proposed to be annexed for the submission of signatures in the
mannerpresoribed in the Eleotions Code, a petition for the annex-
ation of suoh territory, whioh petition oonforms ~o the aforementioned
provisions of the Government Code designated and referred to as the
!Annexation Aot of 1913", and
\1HEREAS it appears that the said petition has been signed by
not less than one-fourth of the qualified eleotorsresiding within
the territory desoribed therein proposed to be annexed to the said
City of Gilroy as shown by the registration of voters of the County
in whi4h such territory is situated, and
~~REAS the provisions of said Annexation Aot of 191a as Bet
forth in the said Government Code require the oity Counoil upon
receiving the written petition above referred to, to pass a resolution
of intention to call a speoial eleotion, giving at least 50 days
notice thereof, and submit to. the electors residing in the territory
proposed by suoh petition to be annexed to suoh oity the question
of whether it shall be annexed to, inoorporated in and wade a part
of such ~lnioipal oorporation.
NO~,TlmREFORE, BE IT RESOLVED that the Common Counoil of the
City of Gilroy, intends to oall a special election above referred
to; that the boundaries of the territory so proposed to be annexed
to said City of Gilroy~re situated in the County of Santa Clara,
state of California, and are more particularly desorib~d as follows,
to-wit:
BEING a part of Ranoh Lots 16 and 20 as shown
on Hap No.7 accompanying the report of the
Referees in the Las Animas Partition Suit,
Aotion No.5536, had in the Superior Court of
the State of California, in and for the County
of Santa Clara, and mare partioularly desoribed
as follows:
Beginning at the intersection of the westerly
line of Princevalle Street with the Southerly
line of Third Street,being the present westerly
Corporate Limits of the City of Gilroy, and

running thence along the southerly line of
Third Street to the Easterly line of Lliller
Avenue; thence westerly aoross Miller Avenue
to the point of intersect ion of the we st erly
line of IvIiller Avenue with the southerly line
of Third Street as shown on rJap entitled
"Tract No.506, Castlewood Park Unit No.l", as
reoorded in Book 18, at page 40, of Maps,
Offioial Reoords of Santa Clara County;thenoe
along the southerly line of Third Street N.
890 13' 30" W. 150.00 feet to the westerly
line of said Castlewood Park;thenoe along the
westerly line of Castl ewood Park S. 0046' 30"W.
928.05 feet to the southerly line of Castlewood
Park;thenoe along the southerly line of Castlewood
Park S.89010'30"E. 150 feet to the westerly line
of Hiller Avenue; thenoe continuing on same course
80.00 feet to the easterly line of Miller Avenue;
thenoe along the easterly line: of Miller Avenue
S.0046'30"W. to its interseotion with the south-
erly line of Fifth Street;thence easterly along
the southerly line of Fifth Street to the west-
erly line of Princevalle Street;thenoe northerly
along the westerly line of Prinoevalle Street to
the southerly line of Third Street and the point
of beginning."
and suoh territory is hereby designated at the Seoond Western Add-
ition to the City of Gilroy for the purpose of identifioation by
which such territory may be referred to an indioated upon the ballot
to be used at the eleotion at which the question of suoh annexation
is submitted; and
BE IT FURT}illR RESOLVED and notioe is hereby given
that lfl'henai.ng'will be held before the Common Counoil of the City
of Gilroy at the City Hall in the City of Gilroy on the 6th day of
April,1950, at the hour of 8 o'olook p.m. when and where any person
owning real property within such territory so proposed to be annexed,
and having any objeotions to the proposed annexation, may appear
before suoh City Council and show oause why suoh territory should
not be annexed. Protests must be in writing, and shall state in
genera 1 terms the name of the owner 0 f the property effected and the
location and area of the property.
Passed and adopted this 20th day of April,1950,by
