PROVIDING FOR THE APPROVAL OF SUBDIVISION,TI1ACT NO.725
REA SUBDIVISION NO.3,ANn ACCEPTING THE LlAP TEEREOF COI~
ITIONED UPON THE EXECUTION OF AN AGR."SEMENT BY THE SUD -
DIVIDERS AND OWNEHS TO INSTALL CURBS, SIFEWALKS AND GUTTERS
AS THE LOTS ARE SOW,AnD TO OIL Al\11) GRADE STREJ~TS AND
ALLEYS AS REQUIRED BY THE COUNCIL,AND THE GIVING OF A
BOND TO COMPLY ;,'lITH THJB AGREEVlENr.
'NHEREAS, Lillian H..Radin and Virginia Cox have subdivided
a tract of land in the west erly part of Gilroy known as Tract
NO.725,Rea Subdivision No.3, and offered to the COillraon Council
fQr filing and approving a Map of said subdivision, and
'iu'HEREAS the I1ayor and :';ornmon Council have heretofore
adopted a resolution wherein and whereby a definite policy
of the Council was set up and adopted prohibiting the appro-
val of any subdivtsion of land or Hap thereof until and unless
the Subdivider or owners of the tract has established,gravelled,
oiled and graded streets and alleys, and installed the sidewalks,
curbs and gutters in the subdivision satisfactory and accept-
able to the COIDraon Council of the City of Gilroy,and
TIHEREAS the said Lillian H..Radin and Virginia Cox have
not complied with the said resolution and have asked the
COTIunon Council of the City of Gilroy to approve the said map
and permit it's filing on the ground that the said subdivision
was started before the said resolution was adopted by the Council,
upon the making of an agreement that they will comply with the
requirements of the said resolution as to every particular
lot in the subdivision if and when sold, and the Common Council
of the:';ity of Gilroy has agreed to ap)rove the subdivision and
mhe Map thereof upon the execution of said agreement and the

making and filing of a good and sufficient surety bond by the
said Lillian R.Radin and Virginia Cox conditioned upon their
complying with their said agreement.
NO';';', TimREFOHE, BJ: IT m~S01'mD by the Connon Council of the
City of Gilroy, that the said subdivision hereinbefore mentioned
the sa~e being tract No.?25, Rea Subdivision No.3, be approved
and the Map thereof accepted for filing, upon the execution by
the said Lillian H.Hadin and Virginia 'Jix of an agreement that
they will comply with the requirel.1ents of' the aforesaid resolution
as to every Darticular lot in the subdivision if an when it is
sold, and that they vvill in an;'l event construct and install
sidevvalks,curbs and gutters in the enti1~e subdivision within a
period of two years from the 2nd day of January,1951, and within
the said time if required by the ,;OlTImOn Council oil and grade
the streets and alleys in the subdivision irrespective of whether
all the lots therein are sold or not, and furnish a surety bond
to be approved by the rJity Attorney of the Jity of Gilroy that
will comply with the said agreement.
