RESOLUTION OF '!BE COMMON COUNCIL OF 'mE CITY OF GILROY CONDITIONALLY
APPROVING FILING OF MAP OR PLAT OF SUBDIVISION DESIGNATED ~ "TRACT
NO.I051 WALNO'l' PARK".

WHEREAS, there has been filed in the office o~ the City Clerk
of the City of Gilroy, a tentative map of * subdivision designated as
"Tract No.l05l Walnut Park", and the Common Council of the City of
Gilroy has been requested to accept and approve said mapjand
WHEREAS,the said Common Council of the City or Gilroy has
heretofore adopted a resolution establishing the policy ot requiring
a subdivider of lands within the City of Gilroy to furnish and install
sewer and water mains,establish,grade and oil streets and alleys
therein,turnish and install fire hydrants and fire bOKe8~nd
construct sidewalks,curbs and gutters,all to the satisfaction ot
the Common Council of the City of Gilroy before and as a oondition
precedent to the acceptance of any subdivision and the filing ot
any map or plat thereot,or, in lieu thereof, to enter into a writt-
en agreement with the City ot Gilroy to construo~,turnish and install
all of the said improvements and perform all of the other work here-
inbefore, mentioned, and to seoure the performanoe of suoh agreement
by the furnishing 0' a good and sufficient surety bond in an amount
to be determined by the said Common Council;and,
WllEREAS, the owners and subdivider of the said tract of land
has requested the said Common Council of' the City of Gilroy to
approve said Map and order the same filed upon the signing ot the
aforementioned agreement andthe furnishing ot the said bond;and,
WHEREAS, the said Common Council in addition to all the
foregoing imp.evements speoifically set forth requires in the case
of the said subdivision that the subdivider furnish a street light
and install same at the easterly end of' the alley shown upon the
map of said subdivision or its easterly prOjection on a utility
pole;and
WHEREAS, the said Common Council has reliable information that
the cost of' furnishing and installing said fire hydrants and fire
boxes,turnishing and installing sewer and water mains ,and oonstruct-
ing .he said sidewalks,curbs and gutters,establishing,grading and
oiling streets and alleys therein, and furnishing an. installing said
street light, is the sum of $20,000.OO,but the City Engineer ot the \
City of Gilroy has not furnished the said Common Council with any
statement or estimate of ~he oost thereof' but will do so;and
WHEREAS, the said Common Counoil does require that all of the
aforementioned improvements and work be compl~ted to the satisfactiQn'
of the said Counoil prior to the 20th day of'August,l953.
mow, THEREFORE, BE IT RESOLVED that the said map and plat ot
said subdivision be accepted and approved by the City of Gilroy and
by the Common Council thereot,upon t~ condition tha~ the afore-
mentioned agreement be exeouted by the subdivider to furnish,install,
oonstruot,and complete the said improvements as herein required
prior to the 20th day of August,1953,and thatx the subdivider furnish
therewith a good and sufficient bond running in favor of the City
of' Gilroy,to be executed by a responsible surety oompany in the
penal sum of $20,000.00 the amount hereinbefore mentioned as the
estimated oost of said improvements,or ins the sum eqUal to the

amount of the estimate by the City Engineer to be made in his report
which shall be filed with the City Clerk of the cost of said improvements,
whichever amount is larger,and which bond is contitioned upon the faith-
ful performance of the said agreement,both agreement and bond to be approved
by the City Attorney of the City of Gilroy and upon the giving,filing and
approving of said bond this acceptance and approval of said subdivision
and map or plat the.eof shall be effective and not otherwise,and the
proper officials of the City of Gilroy shall thereupon execute such
certificates as may be required approving and accepting the said map or
plat of said subdivision in order that it may be entitled to recordation.
ADOPTED and PASSED this 20th day or August,1952, by the following
votes:
