Resolution 283 RESOLUTION NO. 283 RESOLUTION OF THE CO~~ON COUNCIL OF THE CITY OF GILROY PROVIDING FOR NUTICE OF THE PROPOSED ANNEXA.TION OF UNINHABITED TERRITOHY, DSSIGNATED AS "FIHST NORTHERN ADDITION TO THE CITY OF GILROY" TO THE CITY OF GILROY, UNDFR THE A~lliXATION OF ININHABITED TERHITORY ACT OF 1939. WHEREAS, a written petition has heretofore been filed in the office of the Clerk of the City of Gilroy under the provisions of the ItAnnexation of Uninhabited Territory Act of 1939" as set forth within Sections 35300 to 35325, inclusive, of the Government Code of the state of California, asking that there be annexed to the City of Gilroy as uninhabited territory the follO\>J'ing described tract of land, contiguous to the City limits of the City of Gilroy, situated in the County of Santa Clara, State of California, to-wit: Being a portion of Henry Miller's Subdivision of the southerly portion of Las Animas Ranch Lot 34 and SUb Lot 2 according to the Nap thereof recorded in Book "lvI" of Haps, page 79, Records of Santa Clara County, California, and being more particularly described as follows: "Beginning at the intersection of the ,..,esterly line of Murray Avenue with the northerly corporate limits of the City of Gilroy and running thence along said . westerly line N.22020'~v. 407.24 feat to the line common to Lots 7 and 8 as shown on said }rap; thence along the line common to Lots 7 and 8 s.67040'w. 755.49 feet; thence N .22020 "vi. 264.28 feet to the lil...", Cv.wWlon to Dtots 6 and 7 as shown on said Map; thence along said line 8. 67040 n",r. 40.00 feet to the westerly common corner to Lots 6 and 7; thence along the southwesterly line of Lot 6 No22020'W. 26402~ feet to the most westerly corner of Lot 6; thence d.6?o37'W. 826057 feet to the easterly line of the Southern Pacific Railroad Right of Way at the most westerly corner of that certain 20 acre tract of land described in deed recorded in Book 439 at page 45, Offjcial Reeords of Santa Clara County; thence along theeasterly line of the Southern Pacific Railroad property S022 020 IE. 863.15 feet to the intersection thereof with the northerly corporate limits of t~le City of Gilroy; thence easterly along the original corporate limits of the City of Gilroy to the westerly line of Murray Avenue and the point of beginning, contaj.ning therej.n 24.1 acres of land, more or less." and WHEREAS, it appears that petition has been signed by the owners of not less than one-fourth of the area of the land in such territory and , represents not Jess than one-fourth of the assessed value of such territory, according to the last preceding Equalized Assessment Role of the County of Santa Clara, in which such territory is situated, and that the tract therein and herein described is contiguous with the corporate T limits of the said City of Gilroy; and, vJHEREAS, the said "Annexation of Uninhabited Terri tory Act of 1939" above referred to, requires that upon the filj.ng of such a petition, a Resol~)tion shall be adopted by the Common Council giving notice of such proposed annexation, and fixing the time and place of llearing when and where any person owning real property within the said Territory proposed to be annexed may appear and object thereto. NOW, THEREFORE, Br' IT Rr~SOLVrD that the Common Council of the City of Gilroy hereby designates the said territory proposed to be annexed to the City of Gilroy as uFIRST NORTHERN ADDITION TO THE CITY OF GILROYu and that said petition be referred to the City Planning Commission af the City of Gilroy for its report and recornrrlendation thereon; and BE IT FURTHER RESOLVED, and it is hereby ordered, that the 3rd day of November , 1952, at the hour of 8:00 olclock P.M. of said day, in the Council Chambers of the City Hall, Gilroy, California, be, and the same is hereby fixed, as the time and place of the hearing of said petition when and where any person owning real property within such tract so proposed to be annexed and having any objections to the proposed annexation, may appear before the said COlmnon Council and show cause, in writing if any he has, why such territory should not be so annexed.
