NO. ~ OF SAID CCT.lON COUNCIL 11.LL.(TICN TC THE APPROVING AGRI.EJ:IYNT BETI,-J1i.'EN THE:~ITY OF ILROY AND THE STATE OF CALIFOPJ':IA, DEPARTl F:ETT PUBLIC vJORKS, DIVISION OF }U:':;'ffi-TLYS, RELATION TO THE HIDEFING AND II PRO':UENT OF ICNTERfY STP,EET, TO BE KNO\\lN AS IIc;.ILROY COOPERATIVE PROJECT NO. 1.11 \~EREAS, the Common Council of the City of Gilroy did, on the 14th day of September, 1953, adopt resolution No. 299 approving the agreemeht heretofore submitted by the State of California, Department of Public Works, Division of Highways, proposed to be entered into between the said City of State of California, relation to the \\Tidening and iprovement of Monterey ~=.....] ......,.-'--- Gilroy and the said Department of Public Works, Division of Hip,hways of the Street in the s2id City of Gilroy, which said approval of the said agreemeht was conditiohed upon there being inserted and included in the agreement the following provision: liThe property owners owning property situated along Monterey Street shall not be under any direct obligation to pay any portion of the costs of the said improvement, and it is under- stood that all driveways from Monterey street across the sidewalks along the said street shall be altered or reconstruct- ed \\There necessary to establish the proper grade and that portion of down-spouts imbedded in or extending through or altered so that the same will be serviceable, and such re- construction or alteration of said driveways and said portions of down-spouts shall be a part of the improvement covered by this agreement and no part of the cost of such alteration or reconstruction shall be borne by any property owner.n and vf1-i.t:IlliAS, the said Department of Public Works, Division of High- ways, of the state of California, has asked the Corrm'on Council of the City of Gilroy to cancel and delete the said condition from the approval bS the said apreement and Resolution and has in a letter indicated that it will do all the things which the said condition required to bd done and that no part of the cost of the improvement will be directly borne by property owners owning property along Monterey Street in the said City of Gilroy;and hlIE.BEAS, it appears to be unnecessary to have the approval of the said aJreement conditioned as aforesaid. NOW, THEREFORE, BE IT RESOLVED: That the said Resolution No. 299 be, and the same is hereby, rescinded and declared to be of no effect. PASSED and ADOPTED the 23rd .day of September, 1953, by the following vote; AT.tI;S: Councilmen Pate, Kennedy, White, Ronald. NOES: Councilmen Rush, Gallo. ABSENT: Councilmen None.
