RESOLUTION OF THE COIVrJ'JION COUNCIL OF THE CITY OF GILROY FINDING THAT
PROTESTS HAVE BEEN MADE BY THE OWNERS OF A MAJORITY OF THE SEPARATE
PARCELS OF PROPERTY WITHIN THE TERRITORY DESIGNATED AS "THIRD WESTERN
ADDITION TO THE CITY OF GILROY" PROPOSED TO BE A11JJEXED TO SAID CITY,
AND THAT NO FURTHER PROCEEDING;:j SHALL BE TAKEN IN CONNECTION WITH THE
PETITION FOR THE ANNEXATION.
WHEREAS, a petition has hereto~ore been filed in the office of the
City Clerk of the City of Gilroy for the annexation of the following
described property, situated in the County of Santa Clara, State of
California,to the City of Gilroy:
Being a portion of Ranch Lot 16 as shown on
Map No.7 accompanying ~le report of tpe Referees
in the Las Animas Rancho Partition S~it,Action
No.5536 had in the Superior Court of the State
of California, in and for the Oounty of Santa Clara,
and being more particularly described as follows:
Beginning at the point of intersection of the :KEg
southerly line of the Bodfi sh Mill Road ~Hecker
Pass HighwayD as shown on said Map with the
easterly line of Miller Avenue and rlmning thence
along the southerly line. of the Bodfish r..r;ill Road
westerly 410.00 feet;thence r,outherly and parallel
tq Miller. Avenue 773.03 feetyto the northerly line
of the lands of the San Martin Vineyards Company;
thence parallel to the southerly line of the Bodfish
Mill Road easterl~l along the northerly lL ine of the
lands of the San Martin Vineyards Company and the
northerly line of the. "Castlewood Park, Unit No.llt
subdivision to tbe easterly line of Miller Avenue
thence northerly along tbe easterly line of Miller
Avenue 773.0) feet to the point of beginning ,and
CONTAINING TEEREIN 7.276 acres of said Ranch lot 16,
and
WHEREi\.S, the Common Council of the City of Gilroy has hereto-
fore on the 5tb day of 0 ctober,1953,duly ad opted Resolution
No.)02 which,among other things,provided that IV~onday,the 26th
day of Octobt::r,1953,at the hour of 8:00 0 tclock P.M. ,in the
COD@on Council room in the City Hall,Gilroy,Santa Clara County,
state of California, shall be the time for t he hearing of said
pe:tition and of protests against annexation of said propertJ';
and
WHEREAS, notice of the said hearir~ has been given in the
manner and for t he period required by law;and
\~7H8REAS, the. said Common Council of the City of Gilroy has
now met at the time and place fixed in the said D otice for the
hearing of the said petition and for therurpose ofhearing the
same and written protests have been filed in the office of the
City Clerk of t he City of Gilroy by the owners of separate parcels
of land lo.cated in the area sought to be annexed;and
WHEREAS, the said treeitory described in the said petition
and sought to be annexed is comprised of II separate parcels of
land and protests have been made by the owners of the ma,jority
of the separate. parcels of property within the -sndi.ter.rtt.ony,
and under the law no further proceedings shall be taken in
connection with the said proceeding.
NOW, THEREFORE, BE IT RESOLVED:
That written protests have been made in accordance with
the law by the o~ners of the majority of the separate parcels
of property within the territory proposed to be annexed,and
that no further proceedings shall be taken by the Council tin
connection with the said petition or annexation.
PASSED and ADOPTED this 2nd day of November,,1953 by the
following votes:
AYES: Councilmen Pate ,Rush,K ennedy ,White ,.Ronald.
NOES: Councilmen None
ABSENT: Councilman Gallo.
