Resolution 324 .."r--' BESOLitJ'NQN'"iNO. i24 RESOLUTION OF THE COIv'Il'/ION COIDICIL OF T HE CITY OF GILROY PROVIDING FOR NOTICE OF THE PROPOSED ANNEXATION OF UNINHABITED TERRITORY,DESIGNATED AS "CASTLEWOOD PARK, UNIT NO.2'" TO THE CITY OF GILROY,tThTDER THE ANNEX~ ATION OF UNINHABITED TERRITORY ACT OF 1939. WHEREAS,a written petition has heretofore been filed in the office of the Clerk of' the City of Gilroy under the provisions of the ~~ex- at:ioh,.ofcUninhabit.edTe;rritory Act of 1939'. as set forth witl1in Sectiono 35300 to 35325 inclusive, of the Government Code of the State of Calif- ornia,asking that there be annexed to the City of Gilroy as uniahabiued territory ~he following described tract of land, contiguous to the City of Gilroy city limits,situated in the County of Santa Clara ,State of California, to-wit: Being a portion of Ranch Lot 16 as shown on Map No.7,accompanying the reports of the referees in the Las Animas Rancho,Partition Suit,Action No.5536,had in the Superior Court of the State of California,in and for the County of Santa Clara, and being more particularly described as follows: uBEGINNING at the southwesterly corner of "'Rtact No.506,Castlewood Park Unit No.1", as shown on the map thereof recorded in Book 18 of Maps at page 40, Records of Santa Clara County"and running thence along the westerly line thereof N. 0 degree 46~' E. 2002.18 feet to the northwesterly corner thereof; thence along the northerly line of the kands of the San Martin Vineyards Co. N. 89 degree 08' w. 330.00 feet; thence parallel with the westerly line of the said Tract No.506 S. 0 degree 46~' w. 2002..37 feet to the southerly line of said lands of the San Martin Vineyards Co.;thence along said southerly line S. 89 degree 10' E. 330.00 feet to the point of beginning, and CONTAINING THEREIN 15.169 acres of land.tI and WHEREAS, it appears that said petition has been signed by the owners of not less than one-fourth (1/4) of the area of the land in such territory and represents not less than one-fourth of the assessed value of such territory acconding to the last preceding equalized assessment role of the Cownty of Santa Clara ,in which said territory is situated,and that the tract therein and herein described is contiguous with the corporate limits of the said City of Gilroy;and Iv.HEREAS, the proponents of the said annexation have submitted to the Boundaries Commission of the County of Santa Clara the pro- posal for the annexation of the aforesaid territory to the said City of Gilroy and the said Boundaries Commission has reported to the said proponents approving the def'initeness and certainty of the proposed boundaries;amd WHEREAS" the proponents of said annexation have also submitted to the City Planning Commission of the City of Gilroy the proposal for the annexation of the aforesaid territory to the said City of Gilroy,and the said City Planning Commission has reported to the Common Council of the City of Gilroy approving the annexation of said tract; and WHEREAS, the said "Annexation of Uninhabited Territory Act of 193911 above referred to,requires that upon the filing of such patition,a Resolution shall be adopted by the Common Council giving notice of such proposed annexation,and fixing the time and place of hearing when and where any person owning real property within the said territory proposed to be annexed may appear and object thereto. NOtV,:THEREFORE"BE IT RESOLVED: That the Common Council of the City of Gilroy hereby designates that the said territory proposed to be armexed to the City of Gilroy as "Castlewood Park Unit No.2". BE IT FURTHER RESOLVED,Al-l'"D IT IS HEREBY ORDERED: That Tuesday,the sixth day of July,1954, at the hour of 8:00 otclock p.m. of said d~, in the Council Chambers of the City Hall, Gilroy,California,be and the same is hereby fixed as the time and place of the hearing of said petition when and where any person owning real property within such tract so proposed to be annexed and having any objections to the proposed armexation may ap:r;e ar before the said Common Council and show cause in writing,if any he has,why D such territory anould not be so annexed,and the City Clerk of the City of Gilroy is hereby directed to cause to' have pUblished at Je ast once a week for ttwo successive weeks prior to the hearing in the Gilroy 1-' Evening Dispatch, a newspaper of general circulation published in the said City of Gilroy,and in the Morgan Hill Times,a newspaper of general circulation published in t he County of Santa Clara but out- side of the said City of Gilroy,a copy of this Resolution.
