RESOLUTION NO. ~6o
RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY PROVIDING
FOR A NOTICE OF HEARING PETITION FOR THE ANNEXATION GF UNINHABITED
TERRITORY,DESIGNATED AS "SECOND NORrHERN ADDITION-, TO THE CITY OF
GILROY UNDER THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939.
WHEREAS,a written petition has heretofore been filed in the I
office of the Clerk of the City of Gilroy,under the provisions-
of the "Annexation of Uninhabited Zerritory Act of 1939", as set
forth within Sections 3530G to 35325 inclusive,of the Government
Code of the State of California,asking that there be annexed to
the City of Gilroy,as uninhabited terr-itory,the following described
tract of land.,contiguous to the City of Gilroy city limits,
situated in the County of' Santa Clara,State of California, to-wit:
Being a portion of Ranch Lots 24 and 25 as shown
on Map NO.7 accompanying the Final Report of the
Referees in the Las Animas Rancho Partition Suit,
Action No.5536 had in the Superior Court of the
state of California, in and for the County of Santa
Clara,and being moreparticularly described as follow.:
Beginning at the intersection o'f the northwesterly
city limit line of the City of Gilroy with the
Southwesterly line of the State Highway (1955') and
running thence along the said northwesterly City
Limit line a.70OW. 575.11 feet to an iron pipe;
thence N. 21014 'W. 270.90 feet to an iron pipe; thence
along the line cammon to Baid Ranch Lats 24 and 25
westerly 406.37 'feet to' an iron pipe;thence N.l032,
w. 466.48 feet to' an iran pipe in the sautherly line
af the property af the Pentecastal ChurCh;thence
alang said southerly line N.88a30'50ME. 814.08 'feet
to a concrete monument in the southwesterly line af
the State Highway;thence cantinuing alang the
prajection of 'Said southerly line a'f the Pentecostal
Church property N.8803ot50~. to' the intersectian
thereof with the northeasterly line of the Southern
Pacific Railraad property and the present carparate
limi"5s a:fthe City of Gilray;thence alang said line
S.22 22 '3Q'tE. to the intersection thereo'f with the
original nethwesterly limit line oi. the City of
Gilroy;thence along said line S.70W.to the point of
beginning.

WHEREAS,it appears that the said petition has been signed
by the owners of not less than one-fourth (1/4) of the land
in the territory sought to' be annexed by area and by assessed
value, and that the said tract of land is contiguaus to' the
present city limits af the said City af Gilray: and,
. WHEREAS, the propanents af said annexation have heretaf'are
submitted tb the Boundary Commission af' the County af Santa Clara
a propasal for the annexatian af the aforesaid territO'ry to'
the said City of Gilroy,and the saO'd Baundary Cammission has
repO'rted approving the definiteness and certainty af the bO'undaries
O'f the said territO'ry; and,
WHEREAS, the pr~ponents of the said annexation O'f said
territO'ry have alsO' submitt.ed to the City Planning Conmission of
the Ci1ty of Gilroy a proposal for the anneKation of the aforesaid
territO'ry to' the said city, and the 'said City Planmng CO'nmission
has reparted to the Camman Council of the City of Gilroy approving
and recommending the annexatian af said tract; and,
WHEREAS, the said ttAnnexatian of Uninhabited Territory Act
af ~939tt, above referred to', requires upon the filing af such a
petitiO'n a resolution shall be adopted by the Common Council of
the City of Gilroy giving nO'tice af such propO'sed annexation and
fixing the time and place far hearing of th~ petition therefO'r,
when and where any person owning real property within the said
property prapased to be annexed amy appear and object thereto.
NOW,THEREFORE,BE IT RESOLVED:
That the CO'mmon Council of the City of Gilroy does hereby
designate the said territory proposed to be annexed to" the City
af Gilroy as "SECOND NORTHERN ADDITION".
BE IT FURTHER RESOLVED,AND IT IS HEREBY ORDERED:
That the 5th day of December,1955, at thelhour O'f8:o0
o.clack P.M. af said day,in the Common Council Cgambers,in the
City Hall,Gilroy,California be, and the same is hereby fixed
as tbe time and place for the hearing of ~he said petitian and
proposal to' annex said territory, when and where any persan
owning real praperty within such tract or atherwise having a
right to' pratest,and having any objections to' the prapased
annexation,may appnr befare the said Common Council of the City
af Gilroy and show cause, in writing,if any he has, why said
territar,y should nat be sa annexed, and the City Clerk of the City
of Gilroy is hereby directed to cause a copy of the Resalution to
be published at 1e ast once a week for twO' (2) su.ccessive weeks
with the last publication completed at least twenty (gO) ~ays
before the date of hearing, in the GILROY EVENING DISPATCH , a
newspaper of general circulation published in the said City" of
GilrO'y, and in the MORGAN HILL TIMESlfl a newspaper O'f general
circulation,published in the Caunty of Santa Clara, but autside
the city limits of the City of Gilray.
