RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY PROVIDING
FOR A NOTICE OF HEARING PETITION FOR ANNEXATION OF UNINHABITED
TERRITORY,DESIGNATED AS ~SECOND NORTHERN ADDITI~,TO THE CITY OF
GILROY UNDER THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939.
WHEREAS,a written petition has heretofore been filed in the office
of the Clerk o~ the City of Gilroy, under the provisions of the
ltAnnexation of Uninhabited Territory Act of 1939~, as set forth within
Sections 35300 to 3"5325, inclusive ,of the Government Code of the State
of California,asking that there be annexed to the City of Gilroy,as
uninhabited territory,the following described tract of land, contiguous
to the City of Gilroy city limits"situat,ed in the County of Santa Clara,
State of California, to-wit:
Being a portion of Ranch Lots 24 and 25 as shown
on Map No.7 accompanying the Final Report of
the Referees in the Las Animas Rancho Partition
Suit ,Action No.5536 had in t,he Superior Court
of the State of California,in and for the County
of Santa Clara, and being more particularly described
as follows:
Beginning at the intersection of the northwesterly
city limit line of the City of Gilroy with the
southwesterly line of the State Highw~ (1955) and
running thence along: the said northwesterly City
Limit line ~.70OW. 575.11 feet to an iron pipe;
thence N.2l l4tw. 270.90 feet to an iron pipe;thence
along the line common to said Ranch Lots 24 and 25
westerly 406.37 feet to an iron pipe;thence N .10}2 t
w. 466.48 feet to an iron pipe in the southerly line
of the property of the Pentecostal Church;thence
along said southerly line N.88030'50ltE. 814.08 feet
to a concrete monwnent in the southwesterly line of
the State Highway;thence continuing along the
projection of said s8uther~y line of the Pentecostal
Church property N.88 30150"E. to the intersection
thereof with the northeasterly line of the Southern
Pacific Railroad Property and the present Corporate
Limi~s ot :hhe City of Gilroy;thence along said line
S.22 22t30"E. to the intersection thereof" with the
original northwesterly limit line of the City of
GilroYithence along said line S.70oW.to the point
of beg1.nning.
and,
WHEREAS, it appears that the said petitiop has been signed by the
owners of not less than one-fourth (1/4) of the land in the territory
sought t 0 be annexed and by assessed value, and that the said tract
of land is contiguous to the present city limits of the said City ..Ji
of Gilroy;and,
WHEREAS, the proponents of said annexation have heretofore
subrni tted to the Boundary Commission of the County of .tianta Clara
a proposal for the annexation of the aforesaid territory to the
said City of Gilroy"and the said Boundary Commission has reported
approving the definitemess and certainty of the boundaries of the
said territory;and,
WHEREAS, the proponents of the said annexation of said territory
have also submitted to the City Planning Commission of, the City
of Gilroy- a proposal for the annexation of the aforesaid territory
to the said City, and the said City Planning Commission has reported
to the Common Council of the City of Gilroy approving and recommending
the annexation of said tract; and,
WHEREAS, the said tlAnnexation of Uninhabited T.erritory Act of 1939",
above referred to, requires upon the filing of such a petition a
resolution shall be adopted by the Common C~uncil of the City of
Gilroy giving notive of such proposed annexation and fixing the time
and place of hearing of the petition therefor, when and where any
person owning real property within the said property proposed to be
annexed may ap~ and object thereto.
NOW , ~HEHEFGRE, BE IT RESOLVED:
That the Common Council of the City of Gilroy does':hereby
designate the said territory propsed to be annexed to the Cityof
Gilroy as 'tSECOND NORTHERN ADDITION".
BE IT FURTHER RESOLVED,AND IT IS HEREBY ORDEREDt J
That the 21st day of Novembar.1955. at the hour of 8.00 0 'clock I ,:
p.m. of said day, in the Common Council Chambers, in the City Hall,
Gilroy,California,be, and the same is hereby fixed as the time and
place for hearing of the said petition and pr,oposal to annex said
territory,when and where any person owning real property within
such tract or otherwise having a right to protest, and having any
objections t,o the proposed annexation,may appear be.fore the said
Common Council of the City of Gilroy and show cause, in writing, if
any he has, why said territory should not be so annexed,and the City
Clerk of the City of Gilroy is hereby directed to cause a copy of
this Resolution to be published at least once a week for two (2)
successive weeks with the last publication completed at least twenty
(20) days before the date of hearing,in t.b;e GILROYYEVENING DISPATCH,
a newspaper of general circulation published in the said City of
Gilroy, and in the MORGAN HILL TIMES, a newspaper ofr:general
circulation,published in the County of Santa Clara,.but outside the
city limits of the City of Gilroy.
