Resolution 388 HESOLUTION OF INTENTION NO. 388 DECUlliING THE INTENTION OF THE Cm1MON COUNCIL OF THE CITY OF GUROY TO ESTABLISH A STREET LIGHTING DISTRICT COVERING TRACT NO. 239 RENZ ADDITION TO THE CITY OF GIillOY, AND POHTIONS OF TRACTS 1046, WAYLAND LANE TRACT, AND LOUPE NORTHERN ADDITION TO THE CITY OF GILROY, AND TO ORDER THE FlffiNISHING OF STEFL LIGHTING STANDARDS AND STREET LIGHTS IN SAID DISTRICT WHEREAS, the Common Council of the City of Gilroy did, on the 20th day of August, 1956, review and consider that certain report entitled "Report of the City Building Inspector of the City of Gilroy in the Matter of Furnishing and Installation of Steel Lighting Poles and Street Lights for a Street Lighting System for an Improvement District Comprising Tract No. 239 Renz Addition to the City of Gilroy, and Portions of Tracts No. 1046, Wayland Lane Tract, and Loupe Northern Addition to the City of Gilroy, in Accordance with 'Street Lighting Act of 1919' of the State of California", made by the said Building Inspector of the City of Gilroy and filed with the City Clerk, and WHEREAS, said Common Council found said report to be sufficient for the purpose of all subsequent proceedings, and in due and proper form as made and presented and has made no modification thereof. NOW, THEREFORE, BE IT RESOL\~D by the Common Council of the City of Gilroy that the public interest and convenience require, and it is the intention of the Council to order, the following improvement to be made in said City, to-wit: That the obsolete and inadequate lighting system in the District and territory hereinafter specifically described be replaced by steel lighting standards and street lights be installed thereon, as described and set forth in the said Report of said Building Inspector, and that said improvement of the said street lighting iystem shall be for a period of time beginning on the 1st day of November, 1956, and ending on the 30th day of June, 1959. Said furnishing and installation of said lighting poles and installation of lights shall be done strictly in accordance with the plans and specifications therefor prepared as heretofo.re directed. Said Common Council hereby determines and declares that said proposed improvement is of more than local or ordinary puhlic benefit, and will affect and benefit the lands and District herein described, which said District is hereby declared to be benefited by said improvement, and that --.. including all incirlental expenses therefore, the cost and expenses of said improvemenV shall be assessed upon the lands in said District, which District, to be known as the Assessment District, is within the City of Gilroy, County of Santa Clara, State of California, and is particularly bounded and described as follows: Beginning at the intersection of the center line of Welburn Avenue with the westerly line of Wayland Lane as shown on the Map of Tract 911, Renz Addition to the City of Gilroy, according to the map thereof on file in the office of the County Recorder of Santa Clara County, and running thence along the southwesterly line of Wayland Lane in a southeasterly direction to its intersection with the center line of La Sierra Way projected south- westerly; thence in a northeasterly direction along the said center line of La Sierra Way to its intersection with the southwesterly end of said La Sierra Way; thence in a southeasterly direction along the said southwesterly end of La Sierra Way 30.00 feet; thence at right angles in a northeasterly direction 25.00 feet to the center line of an alley; thence in a southeasterly direction along the said center line of said alley to its intersection with the center line of Broadway Street; thence in a northwesterly direction along the center line of Broadway Street to its intersection with the southwesterly line of said Wayland Lane; thence in a southeasterly direction along the southwesterly line of Wayland Lane to a point that is 150 feet southerly, measured at right angles, from the projected southerly line of Broadway Street; thence in a southeasterly direction to the southwesterly corner of r~t 6 in Block 6 North of Range 1 West, the same being in the Loupe Addition; thence in a southeasterly direction along the southerly Ijne of said Lot 6 to the south- easterly corner thereof; thence in a northerly direction along the easterly line of Lot 6 and Lot 5 to the nor th- easterly corner of said Lot 5; thence at right angles and along the southerly boundary line of Lots 4, 10, 11, 12, 13, 14 and 15, 16, and 17 in said block to the westerly boundary line of Lot 11; thence in a southerly direction along the westerly boundary line of said ~t 11 to a point thereon 150 feet distant from the southerly line of Broadway Street; thence easterly along a line parallel with and 150 feet distant at right angles from the southerly line of Broadway Street to the easterly line of Block 6 North, Range 6 West, of the City of Gilroy, the same being in the westerly line of Sargent Street; thence continuing in a straight line to a point in the westerly line of Block 6 North of Range 5 West, of the City of Gilroy, the same being in the Loupe Addition, that is distant 150 feet, measured at right angles, from the northerly line of Hecker Pass Highway, the said point also being the north- westerly corner of Lot 29 in said Block 6 North of Range 5 West in said Loupe Addition; running thence along the northerly lines of Lots 29, 28, 27, 26, 25, 24, 23, 22, 21 and 20 to the intersection of said line with the southerly line of Lot 11 in said Block 6 North of Range 5 West in said Loupe Addition; thence along the southeasterly line of said Lot 11 and its northeasterly prolongation to the center line of Hanna Street; thence in a northwesterly direction along the center line of Ha:ma Street to its intersection with the southeasterly line of Tract 239, 2 Renz Addition to the City of Gilroy; thence along said southeasterly line of said tract 239 to the most easterly corner thereof; thence Northwesterly along the northeasterly line of Tracts 239 and 1046 to the intersection thereof with the center line of Welburn Avenue; thence along the center line of Welburn Avenue to the point of beginning, Saving, excepting and excluding from said District all streets, avenues, lanes, alleys, crossings and places therein included and contained, and all land owned by the Ci ty of Gilroy 0 In these and subsequent proceedings the assessment district above described may also be teferred to as ~Street Lighting District No. l~. The Common Council hereby determines that no part of the cost of said improvement shall be paid out of the treasury fot the City of Gilroy, from the general funds thereof, provided, however, that said City of Gilroy may at any time transfer into the special fund Dr said improvement district, out of any money in the general fund, such sums as it may deem necessary, and the funds so transferred shall be deemed a loan to such special fund and shall be repaid out of the proceeds of the assessments. All proceedings for the aforesaid improvement shall be taken under and in accordance with the provisions of the "Street Lighting Act of 1919~ of the State of California, as amended. ..00000. .
