J' ,,.. j..J RESOLUTION NO. 400 WHEREAS, the City of Gilroy is about to purchase from the Gilroy .school District of Santa Clara County, state of California, the following described property located in the County of santa Clara, state of California, to-wit: Being a portion of Las Animas Ranchlot 23 as shown on Map NO. 7 accompanying the final report of the Referees in the Ias Animas Rancho Partition Suit, Action No. 5;36 had 1n the Superior Court of the State of California, in and for the County of Santa Clara, and being also a portion of Lot 8 as shown On map entitled "Map of Henry Miller's Su.b- di vis ion of Las Animas Ranchlot No. 23 n , which map is recorded in Book "H" of Maps at page ; records of Banta Clara county, California, an! being more particularly descrlbed as follows: Beginning at a concrete monument set to replace the original 4" x 4" stake 82M as shown on said Map No. 7 at the corner common to Ranchlots 23 and 21+ in the southerly line of Ranch lot 2; and running thence along the southwesterly lIne of Ranchlot 24 S. 22.l5'E. 224.42 feet; thence S. 89. 10' W. 461.49 feet to a point :1.n the centerline of wren Avenue (shown as Avenue H on said Henry Miller SUbdivision); thence along the centerline of 11/ren Avenue N. O~2' E. 209.00 feet to an iron pipe at the intersection thereof with the southerly line of Ranchlot 251 thence along the southerly line of Ranchlot 25 N. 89010'1. 373.3, feet to the point of be ginning, and CONTAINING THEREIN 2.00 acres of land, gross and , WHEREAS, the said premises are being purchased by the said City of Gilroy for the express purpose of conve,ying the .ame to the state of California for use as a site for an armory which the State of California has agreed to construct thereUpon; and, WHEREAS, the State of California has declared that it approves the said site for armory purposes, and that it is ready to receive a conveyance of the premises. NOW, THEREF'ORE, BE IT RFSOLVED BY THE COHMON COUNCIL OF THE CITY OF GILROY. That the city of Gilroy, as soon as it obtains title 'to the said premises, convey the said premises to the state of Californ1a, without consideration, and that the deed conveying title shall contain the following condition: "'rhis conveyance is made upon condition that the state will commence construction of a state armory on the premises within five years from the date hereof and will thereafter prosecute such construction to completion with due diligence. Upon failure to so commence a construction ot such State armory, title shall revert to the grantoro" and that the Mayor of the City of Gilroy execute such a deed, T to be attested by the City Clerk of the City ot Gilroy. BE IT FURTHER RESOLVED, That the Mayor and Common Council of the City ot Gilroy believe. that it is justified in giving the said premises to the state ot california for the purposes aforesaid because the location of an armory 1b the City ot Gilroy 1s necessary tor the maintenance of a National (bard Company 1n thi. c1 ty, and. such maintenance ot the National Guard Company is, in the opinion of the Common Council, most adTantageous to the City of Gilroy and of great benefit to the entire area. ..0.0..000.0.0..
