Resolution 401 RESOLUTION NO.401 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY ACCEPTING BID AND AWARDING CONTRACT IN STREET LIGHTING DISTRICT. WHEREAS, the Common Council of the City of Gilroy has heretofore and on October 1,1956,adopted Resolution No.397 entitled "RESOLUTION ORDERING IMPROVEMENT CONSISTING OF STREET LIGHTING TO BE MADE, ADOPTING REPORT OF CITY BUILDING INSPECTOR, CONFIRMING PROPOSED ASSESSMENT,AND CALLING FOR BIDS",ordering the improvement consisting of street lighting to be made, adopting report of the City Building Inspector,confirming proposed assessment,amd calling for bids in connection with an improvement for a street lighting system in the City of Gilroy,which resolution directe~ that the City Clerk adver- tise for bids for the said street lighting system, which street lighting system is more particularly described in the report of the City Building Inspector of the City of Gilroy entitled "REPORT OF THE CITY BUILDING INSPECTOR OF THE CITY OF GILROY IN THE MATEER OF FURNISHING AND INSTALLATION OF STEEL LIGHTING POLES AND STREET LIGHTS FOR A STREET LIGHTING SYSTEM FOR AN IMPROVEMENT DISTRICT COMPRISING TRACT NO.239,RENZ ADDITION TO THE CITY OF GILROY, AND PORTIONS OF TRACTS NO.l046,WAYLAND LANE TRACT,AND LOUPE NORTHERN ADDITION TO THE CITY OF GILROY,IN ACCORDANCE WITH "STREET LIGHTING ACT OF 1919" OF THE STATE OF CALIFORNIA",and in said resolution did fix the 5th day of November,1956, at the hour of 8:00 o'clock as the time when the bids would be publicly opened and examined, and as the time up to which bids will be received for the said street lighting system;and, WHEREAS, the said City Clerk did cause to be published in accordance with said Resolution No.397 by two insertions in the Gilroy Evening Dispatch,a daily newspaper published and circulatedin the City of Gilroy,a notice inviting sealed bids for furnishing and installing said street lighting system in said District;and, WHEREAS, the said Common Council of the City of Gilroy did proceed at the hour of 8:00 o'clock p.m.on November 5,1956, to publicly opeq and examine the said bids for the said work, and the Pacific Gas and Electric Company,a corporation, submitted the bid of $3360.00 for furnishing the steel lighting poles,street lights, conduits and all other equipment and material described in the plaps and spec- ifications for the said work,as set forth in- the said Report of the City Building Inspector of the City of Gilroy,and said bid was the only bid submitted, and WHEREAS, the said Common Council finds that the amount of said bid is reasonable and that the contract sho~d be awar~ed to said Pacific Gas and Electric Company upon its said bid, and WHEREAS, the said Pacific Gas and Electric Company is one of the strongest corporations financially in the United States and no performance or other bond should be required of it in connection with the said work. NOW,THEREFORE,BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF GILROY: That the said bid of $3,360.00 of the Pacific Gas and Electric Company be, and the same is,hereby accepted, and that a contract be entered into with the Pacific Gas and Electric Company in accordance with its bid, and that said contract contain, among other things,a provision that the contractor must provide that the work shall be done strictly in accordance with the plans and specifications above referred to. BE IT FURTHER RESOLVED: That upon the execution of the contract, the certified check of ten percent of the amount of the bid, accompanying the said bid, be returned to the said bidder.
