RESOLUTION NO. 430
RESOLUTION OF THE COMMON COUNC IL OF THE CITY OF GILROY
AMENDING RESOLUTION NO. jS2 RELATING TO THE REQUJREMENTS
OF THE C TIY OF GILROY FOR THE CONSTROCTION AND FURNISHING
OF DRAT NAGE FACILITIES IN SUBDIVIS IONS, PROVIDING THAT
SUBDIVIDERS OR ()l NEBS OF SUBDIVISIONS SHALL PAY A
MINIMUM OF ONE HUNDRED DOLIARS PER LOT TO T HE CITY TO
DEFRAY THE COST OF DRAINAGE FACILITIES IN THE SUBDIVISION
WHEREAS, the Common Council of the City of Gilroy has
heretofore adopted Resolution No. ')82 requiring the
subdivider or owner of subdivisions of land within the
City of Gilroy to pay to the said City the sum of
One Hundred ($100) Dollars per lot to be applied upon the
cost of providing proper drainage facilities for the
subdivision; and,

Resolut!on No. '382 should be amended as hereinafter
set fortho
NOW, THEREFORE, BE IT RESOLVED, AND IT lS HEREBY ORDERED:
That Resolution NO. 382 be, and the same is hereby
amended to read as follows:
PI" ior to the t1 me any map or plat of any su b-
division of land within the City of Gilroy as it
now exists or may hereafter exist, is finally
approved by the Common Council, the subdivider
or OW'ner of the subdivision shall pay to the
City of Gilroy the sum of $100.00 per lot
within the subdivision, or such greater sum as
the Council shall determine to be necessary and
proper, to defray the cost of providing adequate
drainage for the subdiVision, including the cost
of facilities constructed or installed or
enlarged without the subdivision made necessary
in order to secure the proper drainage of the
subdivision, or which are incidental theretoo

That the said drainage system and/or facilities shall
be constructed by the City of Gilroy, and that the
Common Council may at its option, in lieu of requiring
payment of the saiJ sum. per lot as hereinbefore provided,
prior to the approval of said map or plat, approve the
same upon the execution of a written agreement: by the
owner or subdivider of the subdf.. vision that it will
pay the said sum upon demand and furnish a bond of
a responsible and acceptable surety company that it
will pay such sum upon demand if the subdivider or
owner of the subdivision does noto
PASSED and ADOPTED the 20th day of May, 1957, by the
