Resolution 449 I R E 2 Q 1: .IT ! I Q li li r.. '1+9 RESOLUTION NO.. '449 ACCEPTING PERFORHANCE OF CONTRACT DATED APRIL llt ,-"!94-9, ENTERED INTO BETwEEn \.J. R. HOWSON, J. M. Hm-ISON AND '\.JILIIAl1 F. EAIL, EDITH I. HALL AND THE CITY OF GILROY WHEREAS, the City of Gilroy entered into a written contract on the 14th day of April, 1949, with W. R. Howson and Frances N. Howson, his wife, J. M. Howson and Linnie F. Howson, his wife, and William F. Hall and Edith I. Hall, his wife, in which said named individuals agreed to grade and gravel the streets and alleys then not a part of the accepted streets and alleys of the City of Gilroy includp-d within and shown upon the Hap of the sub-division known as GLENVIEW TRACT, the same being known as Tract No. 626, and to furnish and install curbs, gutters and sidewalks all according to the grade fixed by the city engineers, and in accordance with the usual requirements of the City of Gilr6y, and did furnish a surety bond executed by the Glens Falls Indemnity Company in the penal sum of $7,500.00 to secure the performance of said agreement. AND WlffiREAS, said contract has been fUlly performed by said obligors and nothing remains to be done by them thereunder. NOW THEREFORE, be it resolved by the COrImon C01J.ncil of the City of Gilroy that said contract has been fully completed and performed b~T the said \v. R. Howson and Frances N. Howson, his wife, J. I.I. Howson and Linnie F. Howson, his wife, and the said Glens Falls Indemnity Company, surety on 1 '-{ q -1- 1 I the aforesaid bond is hereby exonerated and discharged from all l1abiltty thereunder.
