Resolution 454 -r ~J;.< RESOLUTION NO. 45~ WHEREAS, the City of Gilroy has heretofore entered into an agreement with the Stubnitz Greene Corporation, a corpora- tion, of Adrian, Michigan, wherein the said City of Gilroy has agreed to sell and convey to the said Stubnitz Greene Corporation the northwesterly four acres of a 7.6 acre tract belonging to the City of Gilroy, located along the southwest side of Casey Street between Swanston Lane and the Southern Pacific Railroad Company right of way, the southeasterly line of said four acres being parallel with the said southeasterly line of Casey Street, for the sum of $4,000.00; and WHEREAS, the location of the southeasterly line of the said four acres covered by the a~oresaid agreement has not been determined by a survey, and it is necessary that a survey be made in order to exactly locate the said line and obtain an exact description of the said four acres; and WHEREAS, the City of Gilroy should now execute and deliver to the said Stubnitz Greene Corporation a grant deed conveying title to the said four acre~ and the agreement between the City of Gilroy and the said corporation provides that the said deed shall be placed in escrow with the San Jose Abstract and Title Company to be delivered to the said purchaser upon the payment of the sum of $4,000.00, current lawful money of the United States of America, and the said Stubnitz Greene Corporation is now ready to conclude the transaction and take title to the said property; NOW, THEREFORE, BE IT RESOLVED that the City Engineer of the City of Gilroy cause the said four acres to be surveyed and the boundary lines thereof determined in accordance with the provisions of the aforesaid contract, and that a deed shall be , 51../ / " '"7"" 0" , -r executed on behalf of the City of Gilroy by its mayor and deposited in escrow with the San Jose Abstract and Title Company with instructions to deliver the same to the said Stubnitz Greene Cor- poration upon the payment of the purchase price of $4,000.00, and that the description of the property to be placed in the deed shall be that determined by the aforesaid survey.
