RESOLUTION NO. 455
A RESOLUTION PROHIBITING THE CONNECTION TO THE SEWER LINES OP THE
CITY OP GILROY TO PROPERTY LOCATED OUTSIDE THE CITY LIMITS OF THE
CITY OP GILROY, EXCEPT TO COMMERCIAL AND INDUSTRIAL OWNERS UNDER
CONDITIONS ACCEPTABLE TO THE COMMON COUNCIL OF THE CITY OF GILROY
WHEREAS, requests from time to time have been made to the
Common Council of the City of Gilroy by the owners of property
outside the City limits of the City of Gilroy but adjacent to or
near the said city limits to connect the said property or properties
with the sewer system of the City of Gilroy; and
WHEREAS, the Common Council of the City of Gilroy has generally
refused to permit said sewer connections to be made but has not
established by resolution or ordinance any pol~cy regarding the same;
and
WHEREAS, it is the considered opinion of the said Cammon
Council that the owners of property located outside the city limits
of the City of Gilroy, excepting commercial or industrial property,
should not be permitted to connect their said property with the
sewer lines of the City of Gilroy, and that the Common Council
should adopt.n ordinance or resolution establishing a policy in
regard thereto; and
WHEREAS, the said Common Council believes that there may be
cases in which it may be Idv.atr."~\II to the City of Gilroy and to the
public interest for property located outside the city limit.sot the
City of Gilroy and being used for commercial and/or industrial
purposes to be permitted to connect the said property with the
sewer lines of the City of Gilroy upon such conditions and terms
as the Common Council might deem advisable;
NOW, THEREPORE, BE IT RESOLVED ;
That the Common Council of the City of Gilroy does hereby
establish as a policy of the City of Gilroy that no premises

located outside the City limits of the City of Gilroy, unless the
same is used for commercial and/or industrial purposes, shall be
permi tted to connect said property wi th the sewer lines of the Ci ty
of Gilroy, and no property used for commercial and/or industrial
purposes shall be permitted to connect said property with the sewer
line. of the City of Gilroy except upon terms and conditions which
may be acceptable to the Common Council of theCity of Gilroy.
