RESOLUTION ACKNOWLEDGING RECEIPT OF NOTICE OF INTENTION
TO CIRCULATE PETITION FOR THE ANNEXATION OF TERRITORY TO
THE CITY OF GILROY AND APPROVING THE CIRCULATION OF SAID
PETITION
WHEREAS, a Notice of Intention to Circulate a Petition
for the changing of the boundaries of the City of Gilroy by
the annexation of certain territory adjacent thereto and herein-
after described has been published by the proponents thereof
in the manner required by the Elections Code of the State of
California and in accordance with the provisions of Article
2. of Chapter 1 of Part 2 of Division 2 of Title 4 of the
Government Code, generally referred to and designated as the
"Annexation Act of 1913" and which said Notice of Intention
contains a description of the territory proposed to be annexed
to the City of Gilroy, said premises being that hereinbefore
mentioned and hereinafter particularly described: and
WHEREAS, within ten (10) days after the date of the
publishing of the said notice, said proponents did file a copy of
the said notice, the accompanying statement provided for by
Section 35.113 of the Government Code, and an affidavit of the
publication of the Notice with the City Clerk of the City of
Gilroy, which notice, statement, and affidavit was filed with the
City Clerk on the 21 day of December, 1957: and
WHEREAS, the filing of said notice, statement, and affidavit
have now been presented to the Common Council of the City of
Gilroy and more than 15 days have not elapsed since the filing
thereof with the City Clerk,
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF GILROY: That the said notice, statement, and affidavit
have been filed with the City Clerk of the City of Gilroy
and acknowledgement is hereby made of the receipt thereof, and

that the circulation of the said petition be and the same is
hereby approved.
That the territory hereinbefore referred to and set forth
in the said notice is contiguous to the City of Gilroy and
is described as follows:
BEGINNING at the point of intersection of the southerly line
of the Bodfish Mill Road (Hecker Pass Highway) as shown on
said Map, with the easterly line of Miller Avenue, and
running thence along the southerly line of the Bodfish Mill
Road Westerly 410.00 feet to the northerly common corner
of the lands of L. B. St. Clair and Clark, et al: thence
along the easterly line of the lands of John Clark, et al
S. 00 46' 30" W. 773.03 feet, more or less, to the south-
easterly corner thereof in the northerly line of Tract No.
1232, Castlewood Park, Unit No. 2 as shown on the map thereof
recorded in Book 53 of Maps at pages 12 and 13, distant thereon
N. 890 08' 30" W. 180.00 feet from the northeasterly corner
thereof, being the northwesterly corner of Tract No. 506,
Castlewood Park, Unit No.1, Book 18 of Maps, page 40: thence
along the northerly line of Castlewood Park, and the projec-
tion thereof Units 1 and 2 S. 890 08' 30" E. 410.00 feet to
the intersection thereof with the easterly line of Miller
Avenue: thence along the easterly line of Miller Avenue N.
00 46' 30" E. 773.03 feet, more or less, to the point of
beginning, and
CONTAINING THEREIN 7.276 acres of said Ranch Lot 16.
BEING A portion of Ranch Lot 16 as shown on Map No.7,
accompanying the report of the Referees in the Las Animas
Rancho Partition Suit, Action No. 5536 had in the Superior
Court of the State of California, in and for the County of
Santa Clara, and being more particularly described as above.
PASSED and ADOPTSD this 6 day of January, 1958, by
the following vote:
