Resolution 471 .' \ I RES 0 L UTI 0 N N o. 1..71 , RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY INVOKING THE PROVISIONS OF SECTION EIGHTEEN OF THE CHARTER OF THE CITY OF GILROY AFFECTING PREMISES OF MRS. LUCY T. LEE AND WILLIAM H. BANG. WHEREAS, Lucy T. Lee is the owner of the premises at 751 Fifth Street, Gilroy, California and William H. Bang is the owner of the adjoining premises, known as 741 Fifth Street, Gilroy, California; and, WHEREAS, said Fifth Street from Miller Avenue to Princeva11e Street is paved and gutters and sidewalks have been heretofore con- structed and installed by the property owners on all of the property between the said Miller Avenue to Princeva11e Street, except the said premises of Lucy T. Lee and William H. Bang; and, WHEREAS, the said William H. Bang and Lucy T. Lee have been requested, informally, to install and construct the said sidewalks, curbs, and gutters on their said respective premises, to conform to the remaining property in the said block and they have ignored the said request; and, WHEREAS, in the opinion of the Common Council of the City of Gilroy, the failure to install said sidewalks, curbs, and gutters has resulted in a dangerous condition and in a condition to cause great public inconvenience, particularly during the winter months; and, WHEREAS, Section Eighteen of the Charter of the City of Gilroy sets forth and includes proceedings for the installation and con- struction of sidewalks, curbs, and gutters, under the aforesaid conditions, by the City of Gilroy with the costs thereof to be charged against the property affected, which costs shall constitute a lien against said premises and be collected in the same manner as taxes, and the Common Council desires to invoke the provisions of said section. -1- Y71 , RESOLUTION NO. 471 CONTID. NOW, THEREFORE, BE IT RESOLVED: THAT the City Marshall shall cause notice to be given to the said property owners in writing, in accordance with the requirements of said Section Eighteen of the Charter, requiring them to make the aforesaid improvements and to take the other procedures that are required by said section in the event said property owners fail to construct said sidewalks, curbs, and gutters. BE IT FURTHER RESOLVED: THAT three (3) copies of this resolution, duly certified by the City Clerk be forthwith delivered to the City Marshall of the City of Gilroy.
