RESOLUTION GlV[NG NOTICE OF PROPOSED ANNEXATION TO CITV OF
GILROV OF UNINHABlTED TERRITORV DESCRIBED HEREIN AND DESIGNATED
"JUNG EASTERN ADDITION" TO THE CITV OF GILROY AND GIVING
NonCE OF T[ME AND PLACE FOR HEARING OF PROTESTS THERETO
BE IT RESOLVED BY THE COUNCIL OF THE CITV OF GILROY:
1, That, pursuant to the provisions of the ~nnexation of Uninhabited
Territory ~ct of 1939~ a petition signed by the sole owner of the land in the
hereinafter described terri~ory, by area and by assessed value as shown on the
last equalized assessment roll of the C9unty of Santa Clara, was filed with the
Council of the City of Gilroy on the 16th day of May, 1960, requesting annexa"
tion of the hereinafter described territory to said City,
2, That the territory which the petitioner requests be annexed to
the City of Gilroy and which said City and its Council proposed to annex, is
situate in the County of Santa Clara, State of California, hereby designated
IIJUNG EASTERN ADD[nONII and described as follows:
BEGINNING at a 611 x 811 white post marked IIGilroy Limitsll stand=
ing at the poin~ of intersection of the North line of Old Gil-
roy Street with the Eastern City Limits, and running thence
along the said Eastern City Limits of the City of Gilroy in a
Northwesterly direction, 336,60 feet to the line between Sub~
lots 19 and 19A; thence along the said line between said Sub=
lots 19 and 19A North 570 55' Eo 5.77 Chains to a 4" x 411
white post marked H, 3.M; thence South 320 5' East 8,69 chains
to a 4'1 x 411 white post marked H, 2, M, and South 380 30' Wes~
2,00 chains to a 411 x 4" white post marked H, 1, M and being
the common corner for Ranch Lots 42 and 40 in the North Line
of Old Gi lroy Road, and thence along said North line of said
Old Gilroy Road, the following Gourses and distances: North
510 30' West 1,00 chain to a 411 x 411 white post marked B,O,R,
North 560 16' West 0.38 chains, North 650 56' West 0,38 chains,
North 750 36' West 0,38 chains and North 850 16' West 0.38
chains to a 411 x 4" post marked B,O,R, and being Western end
of first or Western corner of said Old Gilroy Road, and Thence
still along said North line of said Road, South 890 54' West
4,38 chains to the point of beginning, and being designated
on Maps No, 7 and 8, accompanying the Final Report of the Ref-
erees as Sub Lot 19 and Ranch Lot No. 42 in the Partition
Action of the Las Animas Ranch in the Superior Court of the
State of Cal ifornia, in and for the County of Santa Clara,
entitled Henry Miller et aI, vs, Massey Thomas, et aI, Action
No, 5536,
EXCEPTING iHEREFROM all that certain real property situate in
the County of Santa Clara, State of California described as
fo 11 ows:
BEGINNING at a 411 x 411 white post marked H,M. 1 set on the
Northeasterly line of Old Gilroy Road at the Southernmost cor=
ner of that certain 5,67 acre tract of land described in the
Deed from Andreo Repetto et ux, to Agostino Rocchi, et ux,
dated October 31, 1936 and recorded November 23, 1936 in Book
798 of Official Records, page 265, Santa Clara County Records;
thence from said point of beginning North 510 30' West along
the said Northeasterly line of Old Gilroy Road 66,00 feet to
a 411 x 411 white post marked B,O,R.; thence continuing along
the said Northeasterly 1 ine of Old Gilroy Road, North 560 16'
West 9.00 feet; thence North 380 301 East and parallel with the
Southeasterly line of said 5.67 acre tract and its Northeaster~
ly prolongation 159 feet, more or less, to a point on the Nort~
easterly line of said 5,67 acre tract; thence South 320 05' East
along said last named line, 80 feet, more or less, to a 411 x 411
White post marked H, 2, M., set at the Easternmost corner of
said 5,67 acre tract; thence South 380 30' West along said South-
easterly line of 5.67 acre tract 132,00 feet to the point of begin=
ning.
3. That the County ~oundary Commission of Santa Clara County, Calif-
ornia, did in session duly assembled on Monday, May 2, 1960, consider the pro~
posed annexation boundaries of said "JUNG EASTERN ADDITIONII as above described,
and as submitted to said Commission by the proponents of said annexation,
4. That Monday, July 18, 1960, at the hour of 8:00 o*clock p,m, in the
Council Chambers in the City Hall in the City of Gilroy, County of Santa Clara,
California, is hereby fixed as the time and place when and where any person owning
real property within the uninhabited territory above described and proposed to
be annexed to the City of Gilroy, and having any objections to the proposed annexa-
tion, may appear before the Council of the City of Gilroy and show cause why such
uninhabited territory should not be so annexed to the City of Gilroy, The pro-
test must be in writing, may be filed at any time before the hour set for hearing
objections to the proposed annexation, and shall state the name or names of the
owner or owners of property affected and the description and area of such proper-
ty, in general terms.
5. The City Clerk of the City of Gilroy is hereby authorized and directed
to cause a copy of this resolution to be published at least twice, but not oftener
than once a week, in the Gilroy Evening Dispatch, a newspaper of general circula-
tion published in said City of Gilroy, the city towhich it is proposed to annex
the aforesaid territory,
6, In the event there is, upon the land proposed to be annexed to said
City, a structural improvement owned, being acquired or leased by a county fire
protection district, the City Clerk is directed to cause written notice of such
proposed annexation to be mailed to the governing body of such district, such
notice to be sent not less than ten (10) days before the first public hearing upon
such proposed annexation,
7. The City Clerk is directed to cause written notice to be given to
such other persons as may be legally entitled thereto, in the manner required
by 1 aw ,
