RESOLUTION NO. 80-8
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DISAPPROVING ON APPEAL RESOLUTION NO. 80-3 OF THE
PLANNING COl1MISSION GRANTING VARIANCES FOR PARKING
AND REAR YARD SETBACK AT 7130 HANNA STREET
WHEREAS, the City Council by motion duly passed, on
behalf of the CITY OF GILROY, has filed an appeal in due form
from Resolution No. 80-3 of the Planning Commission of the City
of Gilroy granting to JA}ffiS K. OP~DORFF variances for apartment park-
ing requirements and rear yard setback from 15 to 10 feet at 7130
Hanna Street, in the City of Gilroy, and notice of the hearing of
said appeal has been given in the manner required by law and the
Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
January 21, 1980, at 8:00 p.m. in the Council Chambers in the City
Hall at 7390 Rosanna Street, Gilroy, California, and evidence was
submitted upon the said application and the appeal from the findings
of the Planning Commission, the City Council finds:
(1) The proposed two story four-plex use is inconsistent
with the new general plan.
(2) The variances are requested because the site is being
overdeveloped.
(3) The only access to the proposed parking is by a private
alley over property owned by others.
(4) The proposed use will adversely affect other property
in the vicinity or cause damage, hazard or nuisance to persons or
property; and

WHEREAS, the Planning Commission erred in granting the
variances, the variances shall be and the same are hereby denied.
PASSED AND ADOPTED this 21st day of January, 1980, by the
