RESOLUTION NO. 80-25
A RESOLUTION DETERMINING CONVENIENCE AND NECESSITY, AND
ORDERING CHANGES AND MODIFICATIONS, ORDERING INCREASE IN
CERTAIN ASSESSMENTS, ORDERING DECREASE IN CERTAIN
ASSESSMENTS, AND ORDERING INCREASE IN CITY CONTRIBUTION
PARKING DISTRICT NO. 2
RESOLVED, by the City Council of the City of Gilroy, California,
that
WHEREAS, on February 11, 1980, this Council adopted its
Resolution No. 80-20 of Preliminary Determination and of Intention to
Make Changes and Modifications, wherein it did preliminarily determine
that the public interest, convenience and necessity require, and that it
intends to order certain changes and modifications therein particularly
described, in the proceedings being conducted under Resolution No. 79-99
of Preliminary Determination and of Intention adopted by this Council on
November 19, 1979, as amended;
WHEREAS, pursuant to said Resolution No. 80-20 notice has been
duly given of the time and place when and where said Council will
consider and finally determine whether the public interest, convenience
and necessity require said changes, and when and where it will consider
and finally act upon the matter of making said changes and modifications
and when and where it will hear all protests in relation thereto;
WHEREAS, persons interested appeared or filed written protests
against said proceedings or any part thereof and all persons desiring
to be heard were given an opportunity to be heard, and all matters and
things pertaining to said changes and modifications were fully heard and
considered by this Council;
WHEREAS, petitions and consents by the owners of certain
properties have been filed with the City Clerk of this City requesting
that their assessments be increased to reflect certain additional
benefits to their properties; and

WHEREAS, City has determined to increase its contribution to
said project;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows:
1. That all protests and objections be, and they are hereby,
overruled.
2. That the public interest, convenience and necessity require
said changes and modifications as set forth in Resolution No. 80-20 of
Preliminary Determination and of Intention to Make Changes and
Modifications adopted by this Council on February 11, 1980.
IT IS FURTHER ORDERED, as follows:
1. That certain assessments be, and they are hereby, ordered
increased pursuant to petitions and consents signed by the owners
thereof as follows:

2. That certain assessments be, and they are hereby, ordered
decreased as more particularly set forth in Exhibit "A" hereto attached
and by reference incorporated herein.
3. That the contribution by said City in the amount of $75,000
be increased to $96,000.
4. That the total project cost be reduced from $189,000 to
$182,000, that the City contribution to said project be increased from
$75,000 to $96,000, and that the balance to assessment be reduced from
$114,000 to $86,000.
5. That said changes and modifications are hereby ordered to be
made and had, all as more particularly set forth in said Resolution
No. 80-20 and as herein further provided and that the Engineer be, and
he is hereby, ordered to make said changes and modifications either on
the face of the report or by filing an amendment thereto.

California, at a regular meeting thereof held on the 3rd day of March,
