RESOLUTION NO. 80-31
A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE
BOUNDARIES OF THE CITY OF GILROY BY TIIE ANNEXATION
THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED
AS "EAST FREEWAY ANNEXATION 79-5 TO THE CITY OF
GILROY".
WHEREAS, a written petition has been filed in the office of
the City Clerk of the City of Gilroy in accordance with the pro-
visions of the "Municipal Organization Act of 1977", asking that
there be annexed to the City of Gilroy certain uninhabited territory
located in the County of Santa Clara, State of California, herein-
after more particularly described; and
WHEREAS, said petition has been signed and consented to by the
owners of all of the land in the territory proposed to be annexed
and said territory is contiguous to the "City of Gilroy; and
WHEREAS, an application for annexation of the said premises
has been filed with the Santa Clara County Local Agency Formation
Commission, and said Commission did make its determination upon the
proposed annexation, and has approved and authorized said annexation
as proposed pursuant to Section 35157 of the Government Code; and
\nIEREAS, pursuant to Section 35151 of the Government Code the
territory is to be annexed without notice and hearing, and without
an election.
NOW, TIIEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GILROY AS FOLLOWS:
Section I: Under the authority of the said "Municipal Organi-
zation Act of 1977", and Section 35221 of the Government Code of the
State of California, there is hereby annexed to the City of Gilroy
the uninhabited territory particularly described as follows:
BEING a portion of Parcel 3 as sho\\,T11 on Record of Survey
Map filed for record in Book 69 of Haps at page 17, Records
of Santa Clara County, California, and being more particu-
larly described as follows:

BEGINNING at a point in the northerly line of the
SCVWD R.O.W. as conveyed by deed from Richard Brem
and Marian Brem dated September 28, 1960 and recorded
November 22, 1960 in Book 4990 of Official Records,
page 179, said point of beginning being also in the
westerly line of the first above referred Parcel 3
and in the easterly line of East Freeway Annexation
77-2 to the City of Gilroy as described in Ordinance
No. 77-16 of said City adopted April 18, 1977 and
running thence along the easterly line of said
Annexation and the westerly line of said Parcel 3
N.Oo12'20"E. 680.55 feet, N.890l~7'l~0"~J. 379.09 feet
and N.oo12'20"E. 306.08 feet to the northeasterly
corner of said Annexation; thence continuing along
the westerly boundary of said Parcel 3 N.oo12'20" E.
150.62 feet to the northwesterly corner thereof;
thence along the northerly line of said Parcel 3
S.89047'40"E. 1287.78 feet to the northeasterly
corner thereof in the line common to Ranchos San
Ysidro and Las Animas as shown on said map; thence
along said Rancho Line and the northeasterly line
of Parcel 3 S.32005'E. 1299.90 feet to the northerly
line of the above referred SCVWD R.O.W; thence along
said northerly line along a non tangent curve to the
left from a tangent bearing of S.72004'30"\-1. having a
radius of 772.50 feet througq a central angle of
18007' 50" for a distance of 2l~4. 45 feet; thence
N.89047'40"W. 1362.69 feet to the point of beginning,
and
CONTAINING THEREIN 36.998 acres.
Section II: The said territory hereby annexed to the City of
Gilroy is hereby designated as "EART FREEWAY ANNEXATION 79-5 TO THE
CITY OF GILROY".
Section III: This annexation shall take effect on the date of
the recordation of a certified copy of the certificate of completion
with the county recorder pursuant to Section 35354 of the Government
Code.
