RESOLUTION NO. 80-93
A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE
BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION
THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED
AS'~UCHESSA AVENUE ANNEXATION 80-1 TO THE CITY OF
GILROY"
WHEREAS, a written petition has been filed in the office
of the City Clerk of the City of Gilroy in accordance with the
provisions of the "Municipal Organization Act of 1977", asking that
there be annexed to the City of Gilroy certain uninhabited territory
located in the County of Santa Clara, State of California, herein-
after more particularly described; and
WHEREAS, said petition has been signed and consented to
by the owners of all of the land in the territory proposed to be
annexed and said territory is contiguous to the City of Gilroy; and
WHEREAS, an application for annexation of the said premises
has been filed with the Santa Clara County Local Agency Formation
Commission, and said Commission did make its determination upon the
proposed annexation, and has approved and authorized said annexation
as proposed pursuant to Section 35157 of the Government Code; and
WHEREAS, pursuant to Section 35151 of the Government Code
the territory is to be annexed without notice and hearing, and
without an election.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF GILROY AS FOLLOWS:
Section I: Under the authority of the said "Municipal
Organization Act of 1977", and Section 35221 of the Government Code
of the State of California, there is hereby annexed to the City of
Gilroy the uninhabited territory particularly described as follows:
Situate in the County of Santa Clara, State of California
and being a portion of Ranch Lot 48 of the Partition of
the Las Animas Ranch (case No. 5536, in the Superior Court
of the State of California in and for the County of Santa
Clara) and being more particularly described as follows:

Beginning at an iron pipe in the centerline of Luchessa
Avenue marking the most easterly corner of that certain
44.14 acre tract designated as parcel 2, conveyed by
Miller and Lux Incorporated to Alessio Luchessa, et aI,
by deed dated March 30, 1933 and recorded April 8, 1933
in Volume 645 of Official Records at page 283 therein,
Santa Clara County Records and being also the most
easterly corner of the "Fourth Southern Addition" annex-
ation to the City of Gilroy adopted by Resolution 896
on March 3, 1965; thence along the said centerline of
Luchessa Avenue (being the easterly line of said Fourth
Southern Addition Annexation) N320 OS'W, 337.03 feet to
the point of intersection with the northerly line of
said Luchessa Avenue (40 feet wide) as shown on the map
of said Fourth Southern annexation; thence along said
northerly line of Luchessa Avenue S880 43'E, 23.95 feet;
thence along the easterly line of Luchessa Avenue (pro-
ceeding southerly S320 05'E, 2769.33 feet to the point
of intersection with said centerline of Luchessa Avenue
(as it proceeds easterly); thence S720 OO'W, 1735.04 feet
to the point of intersection with the easterly right of
way of the Southern Pacific Railroad Company; thence
along said railroad right of way along a curve to the
right with a radius of 17,139 feet through a central angle
of 060 49' 16" an arc distance of 2040 feet more or less
to the most southerly corner of said Fourth Southern
addition annexation; thence along the southerly line of
said Fourth Southern addition annexation N570 55'E, 1917.
30 feet to the point of beginning and containing 93.330
acres of land more or less. \::>w\dc,
Section II: The said territory hereby annexed to the City
of Gilroy is hereby designated as'~UCHESSA AVENUE ANNEXATION 80-1
TO THE CITY OF GILROY".
Section III: This annexation shall take effect on the date
of the recordation of a certified copy of the certificate of comple-
tion with the county recorder pursuant to ~35354 of the Government
Code.
PASSED AND ADOPTED this 22nd day September, 1980, by the
