RESOLUTION NO. 80 - 94
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY WITHDRAWING FROM THE
SOUTH SANTA CLARA COUNTY FIRE DISTRICT TERRITORY THEREIN RECENTLY
Ai~NEXED TO THE CITY OF GILROY UNDER THE DESIGNATION "LUCHESSA AVENUE
ANNEXATION 80-1 TO THE CITY OF GILROY".
WHEREAS, there has heretofore and on the 15th day of Septem-
ber, 1980, been annexed to the City of Gilroy the following described
property located in the County of Santa Clara, State of California
to wit:
SITUATE in the County of Santa Clara, State of California
and being a portion of Ranch Lot 48 of the Partition of the
Las Animas Ranch (case No. 5536, in the Superior Court of
the State of California in and for the County of Santa
Clara) and being more particularly described as follows:
BEGINNING at an iron pipe in the centerline of Luchessa
Avenue marking the most easterly corner of that certain
44.14 acre tract designated as parcel 2, conveyed by
Miller and Lux Corporated to Alessio Luchessa, et aI,
by deed dated March 30, 1933 and recorded April 8,
1933 in Volume 645 of Official Records at page 283
therein, Santa Clara County Records and being also
the most easterly corner of the "Fourth Southern Addi-
tion" annexation to the City of Gilroy adopted by Reso-
lution 896 on March 3, 1965-; . ... .
THENCE along the said centerline of Luchessa Avenue
(being the easterly line of said Fourth Southern Addi-
tion Annexation) N. 320 OS' W., 337.03 feet to the point
of intersection with the northerly line of said Luches-
sa Avenue (40 feet wide) as shown on the map of said
Fourth Southern annexation; thence along said northerly
line of Luchessa Avenue S. 880 43' E., 23.95 feet; thence
along the easterly line of Luchessa Avenue (proceeding
southerly)S. 320 05' E., 2769.33 feet to the point of
intersection with said centerline of Luchessa Avenue
(as it proceeds easterly); thence S. 72000' W., 1735.04
feet to the point of intersection with the easterly right
of way of the Southern Pacific Railroad Company; thence
along said railroad right of way along a curve to the
right with a radius of 17,139 feet through a central
angle of 060 49' 16" an arc distance of 2040 feet more
or less to the most southerly corner of said Fourth
Southern Addition annexation; thence along the south-
erly line of said Fourth Southern Addition annexation
N. 57055' E., 1917.30 feet to the point of beginning,
and
CONTAINING THEREIN 93.330 acres of land more or less,
and

WHEREAS, said premises so annexed to the City of Gilroy
were at the time of such annexation, included in and formed a part
of the South Santa Clara County Fire District, and the Council of the
City of Gilroy desires that said territory so annexed be withdrawn from
the said fire protection district.
NO\..J, THEREFORE, BE IT RESOLVED, that said territory here-
inbefore described and so annexed to the City of Gilroy as "LUCHESSA
AVENUE ANNEXATION 80-1 TO THE CITY OF GILROY" be and the same is
hereby withdrawn from said South Santa Clara County Fire District.
PASSED AND ADOPTED this 22nd day of September, 1980, by the
following vote:
