RESOLUTION NO. 80- 103
A RESOLUTION APPOINTING ATTORNEYS
OBATA INDUSTRIAL PARK ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Gilroy, California,
that
WHEREAS, this Council has determined to undertake proceedings
pursuant to appropriate special assessment and assessment bond acts for
the acquisition and construction of public improvements in said CitYJ
and
WHEREAS, the public interest and general welfare will be served
by appointing and employing attorneys for the preparation and conduct
of saia proceedings and work in connection with said acquisitions and
improvementsJ
NOW, THEREFORE, IT IS ORDERED, as fOllows:
1. That the law flrm of WILSON, MORTON, ASSAF & McELLIGOTT, San
Mateo, California, be, and it is hereby, appointed and employed to do
and perform all legal services required in the conduct of said
proceedings, including the preparation of all papers not required to be
prepared by the Engineer, examlning and approving the engineering
documents and advising the Engineer in the preparation of his work,
advislng all Clty officials on all matters relating thereto when called
upon, and furnishing its legal opinion on the validity of said
proceedlngs and bonds, and that its compensation be, and it is hereby
fixed at 2-1/2% of the total project cost, or $2,500.00, whichever is
greater, together with reasonable fees for services in acquiring
easements or in eminent domain or other suits, to be assessed as an
lncidental expense of said proceedings.
