RESOLUTION NO. 80-111
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
ABANDONING A PORTION OF A PUBLIC UTILITY EASEHENT
ON A PARCEL ON JUNIPER DRIVE.
W1illREAS, the City Eng;neer has directed to the attention
of the City Council of the City of Gilroy that the following
described portion of a Public Utility Easement has not been used
for the purpose dedicated since being dedicated and recorded on
the 28th day of February, 1968; said portion being more particularly
described as follows:
Being the easterly 3.88 foot wide portion of
that certain Public Utilities Easement (P.U.E.)
8.88 feet in width which lies in the North West
corner of Parcel "A" as said Parcel is shown on
the Record of Survey, recorded in the office of
the Recorder of Santa Clara County in Book 249
of Maps at page 43, reserving the most westerly
5.00 foot width along the nost westerly line of
said parcel "A", said line being U 40 30' E and
33.65 feet in length.
WHEREAS, it further appears frOftl independent evidence
that said portion of easement is not necessary for present or
prospective public use:
NOW, THEREFORE, IT IS HE.1U:BY RESOLVED AND ORDERED pursuant
to the provisions of Government Code section 50443 that the portion
of public utility easement which is described above be and the same
is hereby abandoned.
BE IT FURTHER RESOLVED that the City Clerk be and is
hereby authorized to record a certified copy of this Order.
PASSED AND ADOPTED this 1st day of December, 1980, by
