"...f" ---.~ e --,' \. t e RESOLUTION NO. 77-16 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REGULATING WATER USE PURSUANT TO SECTION 27.30 OF THE GILROY CITY CODE WHEREAS, due to lack of rain, extreme heat and an abnormally low water table, a water shortage exists in the City of Gilroy at the present time, and WHEREAS, regulation of water use in the City of Gilroy from the date of this Resolution until further order of the Council is necessary to conserve available water, NOW, THEREFORE, BE IT RESOLVED, with the concurrence of the Department of Public Works, that pu~suant to section 27.30 of the City Code that: A) Water shall not be used for any outdoor purpose between the hours of 9:00 a.m. and 6:00 p.m. each day, except for: 1. Emergencies. 2. Dust control on construction sites as may be necessary and approved by the City'Administrator upon recommendation of the Director of Public Works. 3. Irrigation of newly planted lawns or vegetation, or to prevent the loss of existing trees, plants or turf, as may be necessary and approved by the City Administrator upon recommendation of the Director of Parks and Recreation. 4. Other circumstances when severe hardship or economic loss would result as may be necessary and approved by the City Administrator. B) Water shall not be used at any time for the fo~lowing pur- poses: l. Washing of sidewalks, driveways, filling station aprons, porches and similar outdoor surfaces, or any other outdoor use which permits excess water to flow into an alley or street gutter. -1- R€SOLUTION NO. 77-16 .. ,-.,... - e e v , ... ..;., ~ 2. Washing of the exterior of dwellings, building and structures with the exception of window washing. 3. Ornamental fountains or any other structure making a use of water unless they employ a recirculating system. 4. Use of "the running hose" when washing automobiles, trucks, trailers, trailer houses, boats and mobile homes. Commercial automobile washing is permitted when water is recycled within an approved tolerance. C) All broken or defective plumbing, sprinkler, watering or irrigation systems which permit the escape or leakage of water shall be repaired. BE IT FURTHER RESOLVED that violation of the above provisions implementing section 27.30 of the City CQde shall be deemed an infraction, and the Departments of Public Works, Parks and Recreation and Police are directed to issue citations therefore; provided that any person so cited who disputes the City Administrator's determination , I as to lack of necessity may request review and dismissal of the citation by the Council at its next regular meeting and prior to court appearance on the citation.
