RESOLUTION NO. 77-26
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
REGULATING THE SALE OF "SAFE AND SANE" FIREHORKS
PERMITTED UNDER SECTION lO.lOCb) OF THE GILROY CITY
CODE
WHEREAS, due to personal injuries and fire damage resulting from
the discharge of fireworks in the City and surrounding area, further
regulation of the sale of "safe and sanelt fireworks in the City of
Gilroy from the date of this Resolution until further order of the
Council is necessary for public safety and welfare.
NOW, THEREFORE, BE IT RESOLVED, that pursuant .to section lO.lOCb)
of the City Code, only "safe and saneu fireworks shall be sold in the
City, and shall be sold only under the following express conditions:
1. Retailers shall not sell fireworks to anyone less than 16
years of age.
2. Only boxed assortments packed by a wholesaler or manufacturer
shall be sold by the retailer in the original package.
3. Retail sales of such boxed assortments shall be made only
between July 1 and July 4 of each year. '
4. A safety pamphlet on the use of "safe and sane" fireworks
furnished by the manufacturer shall be given by the retailer tp each
purchaser at the time of sale. ."',
BE IT FURTHER RESOLVED that a copy of this resolution shall be
given to each retailer when a business license is applied for, and that
violation of the above provisions implementing section lO.lOCb) of the
City Code shall be deemed an infraction, and the Departments of Fire
and Police are directed to issue citations therefore.
