RESOLUTION NO. 77 - 38
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REGARDING
AIR QUALITY MAINTENANCE PLANNING FOR PROJECT NO. C-06-l0l9.
WHEREAS, it is the policy and responsibility of the
State Water Resources Control Board to minimize air quality impacts
of Clean Water Grant Projects in critical air areas of the State
of California;
WHEREAS, the State Water Resources Control Board has
the responsibility of insuring that Clean Water Grant Projects do
not interfere with attainment and/or maintenance of ambient air
quality standards:
WHEREAS, the City of Gilroy has applied for a Clean
Water Grant for expansion of sewage treatment facilities;
\~EREAS, the Environmental Impact Report prepared for
this project identifies possible adverse air quality impacts from
the project;
WHEREAS, it is desired to provide industrial reserve
capacity of 1.2 MGD;
WHEREAS, the State Water Resources Control Board accepts
flow-limiting grant conditions and participation in Air Quality
Maintenance Planning in lieu of specific mitigation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF GILROY AS FOLLOWS:
1) To continue to participate and cooperate as a member
of the Association of Bay Area Governments (ABAG) in
the development of an Environmental Management Plan,
including an Air Quality ~1aintenance Plan for the
San Francisco Bay Region;

2) To make reasonable efforts consistent with the
resources and goals of this City to insure that
the adopted Air Quality Maintenance Plan provides
adequate means for mitigating any adverse impacts
on air quality resulting from the proposed project;
and
3) That upon adoption of the Air Quality Maintenance
Plan by ABAG, and approval by the State and EPA,
the City shall render reasonable assistance for
implementation of said plan.
