RESOLUTION NO. 77-87
RESOLUTION OF INTENTION TO VACATE THE SIXTY (60) FOOT
PORTION OF LAS ANIIvlAS AVENUE IN THE CITY OF GILROY
CONTIGUOUS WITH THE SOUTHERN PACIFIC RAILROAD RIGHT OF
WAY, RESERVING TO THE CITY EASEIvlENTS FOR ALL PUBLIC
FACILITIES.
~lEREAS, Las Animas Avenue in the City of Gilroy, is one of the
public streets in said city and the sixty (60) foot portion thereof
which is contiguous with the Southern Pacific Railroad Right-of-Way
is unnecessary for present or prospective public street purposes and
should be vacated, but that public convenience and necessity require
the reservation of easements for all public facilities;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Gilroy that it does hereby declare its intention to vacate the sixty
(60) foot portion of Las Animas Avenue in said City of Gilroy which
is contiguous with the Southern Pacific Railroad Right-of-Way~
reserving to the City all easements for public facilities set forth in
Streets and Highways Code section 8330;
BE IT FURTHER RESOLVED that this Resolution shall be published
and said street posted as required in the Street Vacation Act of 1941,
under which this proceeding is instituted, and the 3rd day of January,
1978, at 8:00 o'clock p.m., in the Council Chambers, City Hall, 7390
Rosanna Street, Gilroy, California, is hereby designated as the time
and place at which said City Council shall hear any and all persons
interested in or who may object to the proposed vacation.
One publication of said notice shall be made in the Gilroy Dispatch,
a newspaper published in the City of Gilroy, at a date at least ten
(10) days prior to the time of hearing.
PASSED AND ADOPTED this 19th day of December, 1977, by the following
