RESOLUTION NO. 76-11
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING
THE SOLID WASTE MANAGEMENT PLAN FO~ SANTA CLARA COUNTY.
m1EREAS, the Nejed1y-Z'Berg-Di11s Solid Waste Management
and Resource Recovery Act of 1972 (hereafter referred to as the
Act) requires each County In cooperation with affected local
jurisdictions to prepare a comprehensive, coordinated Plan for the
management of solid wastes; and
WHEREAS, this City has participated In the preparation of
the Solid Waste Management Plan for Santa Clara County through its
elected officials (the Planning Policy Committee for Santa Clara
County and the Board of Supervisors) and Staff (the Solid Waste
Management Study Technical Advisory Committee) over the past two
years; and
WHEREAS, the City of Gilroy recognizes the need for coordina-
tion and planning of future solid waste management activities, both
locally and regionally in accord with the Act; and
WHEREAS, participation in a joint effort for short, mid-,
and long-range solid waste management planning will be for the
express purpose of enhancing the existing system and deriving optimum
benefits from resources recoverable from the waste stream; and
m1EREAS, the City of Gilroy has reviewed said Plan with specific
reference to the objectives of the Plan, the methods and/or organiza-
tion for implementation of the program, the procedures for financing
the recommended program and the role identified for this City in the
Plan; and
WHEREAS, the City has received the following assurances from
the County of Santa Clara:

1. All refuse disposal facilities presently located in South
Santa Clara County shall be reserved for the future exclusive use
of residents and businesses of South Santa Clara County.
2. The present method of inspection of refuse disposal sites
by the County Health Department and the funding of these services
1S considered adequate and appropriate. The City of Gilroy desires
to reserve the right of approval of any change in these services,
the rates charged therefore, and the establishment of a new or
alternate agency to assume these inspection responsibilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
~ty of Gilroy concurs in the principles and objectives of the Plan
for the purposes of Section 66780, California State Government Code.
BE IT FURTHER RESOLVED that the City Clerk is directed to
forward a certified copy of this Resolution to the Santa Clara
County Board of Supervisors.
