RESOLUTION NO. 76-18
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY AFFIRMING
ON APPEAL RESOLUTION NO. 76-9 OF THE PLANNING COMMISSION
DENYING A CONDITIONAL USE PERMIT TO CONSTRUCT APARTMENTS
IN AN "H2" (LIGHT INDUSTRIAL) DISTRICT LOCATED AT 30
WELBURN AVENUE
WHEREAS, THOMAS H. RUIZ has filed an appeal in due form from
Resolution No. 76-9 of the Planning Commission of the City of Gilroy
denying a conditional use ,permit to construct apartments in an "M2"
(Light Industrial) District located at 30 Welburn Avenue, Gilroy,
Ca~ifornia, and notice of the hearing of said appeal has been given
in the manner required by law and the Zoning Ordinance of the City of
Gilroy; and
WHEREAS, the said hearing on the appeal has been held on April
5, 1976, at 8:00 p.m. in the Council Chambers in the City Hall at
7390 Rosanna Street, Gilroy, California, and continued to this date,
and evidence was submitted upon the said application and appeal from
the findings of the Planning Commission, the City Council finds:
(1) The findings of the Planning Commission are hereby approved;
and
(2) The Planning Commission did not err in denying the conditional
use permit.
THEREFORE, BE IT RESOLVED that Resolution No. 76-9 of the Planning
Commission is hereby affirmed.
PASSED AND ADOPTED this 19th day of April, 1976, by the following
vote:
