RESOLUTION NO. 76-25
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
AUTHORIZING LEGAL REPRESENTATION BY THE PACIFIC
LEGAL FOUNDATION IN LITIGATION AFFECTING CONSTRUCTION
OF THE SAN FELIPE DIVISION AND THE SAN FELIPE WATER
DISTRIBUTION SYSTEM
\~IEREAS, the official position of the City of Gilroy has
been, since the introduction of the initial legislation, to
support construction of the San Felipe Division of the Central
Valley Project; and
WHEREAS, construction of the San Felipe Division and the
San Felipe Water Distribution System are vital to the economic
development and well-being of the City of Gilroy and will
represent a source of future municipal water; will provide
additional water for the Central Valley Project; will assure
water for southern Santa Clara County; will stabilize ground
water levels and prevent further subsidence of lands in the
Llagas Groundwater Basin; will improve water quality in the
Llagas Groundwater Basin; will provide water to meet increasing
agricultural and recreational demands in southern Santa Clara
County; \vill provide additional flood protection; and will provide
for storage of a supplemental water supply; and
WHEREAS, a formal contract for delivery of water was
entered into by the Bureau of Reclamation and the Santa Clara
Valley Water District on April 15, 1976, and bids for construc-
tion of the first major elements of the project have been
received by the Bureau of Reclamation; and
WHEREAS, certain groups and individuals are seeking to
delay and enjoin construction of these needed public facilities
and have filed litigation against the United States Bureau of
Reclamation and the Santa Clara Valley Water District for this
purpose; and
WHEREAS, the Pacifi.c Legal Foundation is a nonprofit public
interest legal foundation duly organized and existing under and
by virtue of the laws of the State of California for the purpose
of engaging in litigation on behalf of the public in matters
affecting the public interest; and
mIEREAS, it is in the public interest for the City of
Gilroy to participate in the current litigation affecting
construction of the San Felipe Division and the San Felipe
Water Distribution System,
NOW THEREFORE BE IT RESOLVED that the Pacific Legal
Foundation be retained and authorized by the City of Gilroy
on a nonprofit reimbursement basis to take all necessary and
appropriate legal action to assure the timely construction of
the San Felipe Division and the San Felipe Water Distribution
System, the court costs of said legal action, but not attorneys
fees, to be shared on a fair and reasonable basis with others

similarly authorizing such representation, with the fair share
of the City of Gilroy not to exceed $1,000.00.
