RESOLUTION NO. 76-54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING
ADDENDUM TO THE SOLID WASTE MANAGEMENT PLAN FOR SANTA CLARA COUNTY.
WHEREAS, the Solid Waste Management Plan for Santa Clara
County has been previously submitted to and approved by the City
Council; and
WHEREAS, an addendum to said plan regarding a facilities
plan and a Solid Waste Planning Committee has been prepared and
submitted to the City Council; and
WHEREAS, the proposed addendum has been reevaluated for
consistency with the previously approved plan and its effect on
the local interests of Gilroy;
NOW, THEREFORE BE IT RESOLVED that the Gilroy City Council
hereby approves the addendum to the Solid Waste Management Plan
for Santa Clara County, shown as Attachment "A" to this resolution
and made part hereof by this reference.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Gilroy this 15th day of November, 1976, by the fol-
lowing vote:

Addendum to THE SOLID WASTE MANAGEMENT PLAN FOR
SANTA CLARA COUNTY, DECEMBER, 1975

1. Recommended Facilities Plan. . . page 11, add a new paragraph 2, to read:
Sites for future processing plants and landfill for disposal are necessary
for the orderly Implementation of this Plan. Such sites must be determined
.
by a thorough consideration of environmental, geologic, economic, social
and po 11 t I ca 1 factors, and any potent i a 1 site wIll be subject to all l.oca 1
regulatory ordInances aftd review procedures, as well as to a variety of
regional and state regulations. This Plan makes use of some assumed loca-
tIons for facIlities in order to develop cost comparisons and material
projections .as required by State law. However, they have neither been
thoroughly investigated nor endorsed by any jurisdiction and no assumptions
are to be made concerning the appropriateness of any indicated location as
it might be related to all of the site factors noted above. Determination
of precise locations will be the function of each Joint Powers Agency for
each Service Area, undertaken in the time when each identifies its needs
more precisely than this Plan can do. No single community or area of the
County should bear a disproportionate share of any disadvantages associated
with having such facilities nearby.

2. The Solid Waste Planninq Committee. . . page 15, change to read:
A Solid Waste Planning Committee for Santa Clara County will be designated
by the County Board of Supervisors and City Councils within 60 days after
approval of the Countywide Plan by the State Solid Waste Management Board.
This Committee will be the overall coordinating and monitoring body for
solid waste matters throughout the County" It will be advisory to the
Board of Supervisors and the City Councils during the formation period for
Joint Powers Agencies In the County, and, thereafter, advisory to the
Countywide and Service Area Joint Powers Agencies.

An interim system of representation will be utilized during the JPA'forma-
tion period. The Planning Polley Committee ~or Santa Clara County will be
. designed to function as the Solid Waste Planning Committee during this
period. Since they have been mentors'of the Plan program over the past
few years, this will maintain continuity and will take advantage of the
familiarity and expertise which they have developed. For this purpose the
membership will be augmented with representation from the local solid
waste Industry in order to Insure adequate and equitable consideration of
the Issues.
Voting In the Committee will be a matter for their choice between a conven-
tional system or a system of weighted voting. If wei'ghted voting is
selected, then the system will be adapted from the Intercity Council System
modified to accommodate the County and waste management industry members.

The system of representation and votIng will be reviewed for adequacy after
the JPA's have been fonned and when the varIous work programs have bee~ more
clearly defined.
