RESOLUTION NO. 75-17
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING THE APPEAL FROM RESOLUTION NO. 756 OF THE
PLANNING COMMISSION GRANTIHG A CONDITIONAL USE PERMIT
TO MADONNA VILLAGE PARENTS ASSOCIATION.
WHEREAS, DAVID W. llANSEN, Director of Public Works, on behalf
of the CITY OF GILROY has filed an appeal in due form from
Resolution No. 756 of the Planning Commission of the City of Gilroy
granting a conditional use permit to operate a day care center for
children located at Hadonna Village, in the City of Gilroy, and
notice of the hearing of said appeal has been given in the manner
required by law and the Zoning Ordinance of the City of Gilroy;
and
\rrIEREAS, the said hearing on the appeal has been held on May
19, 1975, at 8:00 p.m. in the Council Chambers in the City Hall at
7390 Rosanna Street, Gilroy, California, and evidence was submitted
up0n Lhe said application and appeal from the findings of the
Planning COmIT4ission, the City Council finds;
(1) That the proposed use is properly located in relation to
the General Plan and to the couwaunity as a whole and to other land
used and to transportation and service facilities in the vicinity
as deterluined by the Planning Commission from substantial evidence;
and
(2) That the proposed use, if it complies with all conditions
upon which approval is made contingent, will not adversely affect
other property in the vicinity or cause damage, hazard or nuisance
to persons or property as determined by the Planning Commission from
substantial evidence; and
~{HEREAS, the Planning COIDTIlission did not err in granting the
use permit based on evidence presented at the Planning Commission,

the appeal shall be and the same is hereby denied,
PASSED AND ADOPTED this 19th day of May, 1975, by the
following vote:
