Resolution 1975-27 .: .e e . " \ ~ <1. RESOLUTION NO. 75-27 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING THE NATIONAL ELECTRICAL CODE 1975 EDITION. WHEREAS) Section 6.1 of the Gilroy City Code provides that the latest edition of the National Electrical Code shall be submitted to the Council to become effective within the City upon approval by resolution, subject to possi- ble modifications and amendments, and WHEREAS) the 1975 edition of said code has been submitted with modifica- tions and amendments by the Senior Building Inspector. NOW) THEREFORE) THE CITY COUNCIL OF THE CITY OF GILROY DOES RESOLVE AS FOLLOWS: That the National Electrical Code, 1975 Edition, shall apply to construc- tion of all kinds in the City of Gilroy subject to the modifications and amend- ments developed and recommended by the Gilroy Building Department. They are to add to, replace and supersede the respective sections and subsections appearinq in said Code prior to such modifications. SECTION 90-4. ORGANIZATION AND ENFORCEMENT. a. Right of Entry. Whenever necessary to make an inspection to enforce any of the provisions of this Code, or whenever the Building Official or his authorized representative has reasonable cause to believe that there exists in any building or upon any premises, any condition which makes such building or premises unsafe, the Building Official or his authorized representative may enter such building or premises at all reasonable times to inspect the same or to perform any duty imposed upon the building by this Code; provided that if such building or premises be occupied, he shall first present proper credentials and demand entry; and if such building or premises be unoccupied, he shall first make a reasonable effort to locate the owner or other persons having charge or control of building or premises and demand entry. If such entry is refused, the Building Official or his authorized representative shall have recourse to every remedy provided by law to secure entry. No owner or occupant or any other person having charge, care or control RESOLUTION NO. 75- 27 -1- ~ e e of any building or premises shall fail or neglect, after proper demand is made as herein provided, to properly permit entry therein by the Building Official or his authorized representative for the purpose of inspection and examination pur- suant to this Code. Any person violating this subdivision shall be guilty of a misdeameanor. b. Stop Orders. Whenever any work is being done contrary to the provi- sions of this Code, the Building Official, or his authorized representative, may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be done, and any such persons shall forth-with stop such work until authorized by the Building Official, or his authorized repre- sentative, to proceed with the work. c. Authority to Disconnect Dangerous Installations. The Building Official, or his authorized representative, is hereby authorized to order discon- tinuance of electrical service to any electric wiring, devices, appliances or equipment found to be dangerous to life or property because they are defective or defectively installed until such wiring, devices, applicances and equipment and their installation have made safe and approved by the Building Official, or his authorized representative. d. Unlawful Connections and Reconnections. Generally. It shall be unlaw- ful for any person to make connections from a source of electrical energy or to supply electric service to any electrical wiring, devices, appliances, or equip- ment which has been disconnected or orldered to be disconnected by the Building Official, or his authorized representative, or the use of which has been ordered by the Building Official, or his authorized representative, to be discontinued until approval has been issued by him authorizing the reconnection and use of such wiring, devices, appliances or equipment. The Building Official, or his authorized representative, shall notify the serving utility of such order to discontinue use. SECTION 90-8. PERMITS AND INSPECTIONS. a. Permits Required. No person shall install, alter, reconstruct, main- tain or repair any electrical equipment regulated by this Code unless a permit therefor has been obtained from the Building Official except as otherwise provided in this Code. -2- . , e e .; . A separate permit shall be obtained for the equipment installed in each separate building or structure. No permit shall be required for the following: 1. Installation of temporary wiring for experimental purposes in suitable experimental laboratories. 2. Replacement of lamps or the connection of portable appliances to suit- able receptacles which have been permanently installed. 3. Electrical work on Public School property where such work has the ap- proval of the Department of Public Works of the State of California. b. Permit Application. To obtain a permit, the applicant shall file an application on forms furnished for that purpose. The application shall con- tain all information necessary to the lawful enforcement of the provisions of this Code. c. Plans and Specifications. When required by the Building Official for the enforcement of any provisions of this Code, plans, specifications and one line diagrams showing total loads for the installation of electrical work shall be filed with the Building Official and approved before issuance of any permit for the following: 1. Any new commercial, industrial or public buildings. 2. Existing commercial, industrial or public building where additional electrical load is added. 3. Apartment buildings. 4. All other occupancies utilizing electric for primary comfort heating, exclusive of unit heaters in bathrooms or similar areas. The Building Official may require such plans, specifications or one line diagrams to be prepared and designed by an engineer or architect licensed by the State to practive as such. Two sets of plans and specifications and or line diagrams shall be filed for checking. After approval one set of plans shall be retained by the Building Official and the other set shall be returned to the applicant, which set shall be kept on such building or work at all times during which the work authorized is in progress. -3- ~ , e e The approval of any such plans or specifications shall not be construed to sanction any violation of this Code. d. Persons to Whom Issued. Permits shall only be issued to: 1. Owners of single family dwellings. 2. Electrical contractors who are in compliance with the State Licensing l~. 3. Governmental Agencies. Owners Permit. The Building Official may issue to an individual an owner's permit authorizing said individual to install, alter, change or repair electrical equipment in, on or about a one family residence of which said individual is owner and in which he resides or intends to reside, but not elsewhere. No electrical work authorized under any such owner's permit shall be done, nor shall the owner holding such permit allow any such work to be done, except personally by the owner to whom the permit is issued or by a member of his immediate family. e. Validity. The issuance or granting of a permit or approval of pl~ns and specifications shall not be construed to be a permit for, or approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except in so far as the work or use which it authorizes is lawful. The issuance of a permit based upon plans and specifications shall not pre- vent the Building Official from thereafter requiring the correction of errors in said plans and specifications or from preventing construction being carried on thereunder when in violation of this Code or any of any other ordinance. f. Expiration. Every permit issued by the Building Official under the provisions of this Code shall expire by limitation and become null and void, if the building or work authorized by such permit is not commenced within 60 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommended a new permit shall be first obtained so to do, and the fee therefor shall be one-half of the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that such suspension or abandonment has not exceeded one year. -4- . . e e g. Suspension or Revocation. The Building Official may, in writing. sus- pend or revoke a permit issued under provisions of this Code whenever the pernlit is issued in error or on the basis of incorrect information supplied. or in viola- tion of any ordinance or regulat-jon lor any of the provisions of this Code. h. Penalty Fee. Where, for which a permit is required by this Code, is started or commenced without obtaining a permit. the fees specified shall be doubled. except that where the penalty fee is less than ten dollars. the penalty fee shall be the standard permit fee and inspection fee. plus ten dollars. The payment of such penalty fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work. nor from any other penalties prescribed herein. i. Permit Fees. Any person des i ri ng a permit required by thi s Code. shall. at the time of issuance of such permit. pay a fee as required by this section. Inspecti on. All equipment for which a permit is obtained under this Code shall be inspected by the Building Official or his representative. No portion of any equipment intended to be concealed by any permanent portion -5- .. ., e e of the building until inspected and approved. When the installation of any equipment is complete, a second or final inspection shall be made. Equipment regulated by this Code shall be connected to the power supply until authorized by the Building Official or his representative. k. Request for Inspection. The Building Inspector may require that every request for inspection be filed at least one day before such inspection is desired. Such request may be in writing or by telephone at the option of the Building Inspector. It shall be the duty of the person requesting inspection of any equipment regulated by this Code to provide access to and means for proper inspection of such equipment. The Building Inspector shall not be liable for any exoense entailed in the removal or replacement of any material required to allow the inspection. 1. Approval of Work. Where the B~tlding Inspector finds the installa- tion to be in conformance with the provisions of this Code, the inspector shall indicate such approval by signing and dating the permit card. Upon final inspec- tion and approval of the building and premises in accordance with applicable laws of the City, the Building Inspector shall notify the serving electrical utility of such approval and shall authorize the connection of the installation to the source of supply. m. Temporary Electric Permit. A temporary electric meter set may be authorized for the connection and use of specific portions of an incompleted instal- lation. Persons desiring a temporary meter set shall pay a special inspection fee. Permit shall be issued to expire at a time specified thereon and shall be revocable by the Building Inspector upon ahy Code violations. Amend Article 250-82 (b) to read as follows: Concrete- encased steel rein- forcing bar system of underground footings or foundations where the total bar length, diameter, and depth below earth surface are not less than forty (401) feet, YzII inch, and one foot (1211) respectfully. The required length shall be made up of not more than two bars and shall be continuous and be set three inches (311) from bottom of footing. The point of attachment for the grounding electrode and the grounding conductor shall be readily accessible. -6- .. . t. e e f, Add paragraph (c) to Section 300-1. (c) All electrical wiring, with the exception of exclusions provided for in Section 300-1 (a) and (b), shall be installed in approved raceway for all buildings and structures, other than residential or apartment buildings. Elimination of raceways required above for remodeling will be determined by the Building Inspector unless otherwise required by the 1975 National Electric Code. Amend Article 680-8 by adding paragraph (d): When swimming pool is in a yard where utility overhead electric power lines are located, the inside edge of the wall of the pool may be five feet (51) horizontally from the utility overhead conductors providing also that these conductors have a minimum clearance of twenty feet (20') radius from the inside edge of the pool wall.
