RESOLUTION NO. 75- 39
A RESOLUTION DETERMINING TO ABANDON IMPROVEMENT PROJECT
CHESTNUT STREET-MURRAY AVENUE IMPROVEMENT DISTRICT
PROJECT 1974-1
RESOLVED, by the City Council of the City of Gilroy,
California, that
WHEREAS, this Council did on the 19th day of May, 1975, adopt
its Resolution of Preliminary Determination and of Intention
No. 75-20 relating to the acquisitions and construction of improve-
ments in and for said City;
WHEREAS, on May 19, 1975, this Council adopted a resolution
appointing time and place of hearing protests in relation to the
proposed acquisitions and improvements and directing notice;
WHEREAS, notice was given of the time and place therein stated
in the manner provided in Chapter 12A, Article II of the Gilroy
City Code and Section 17 of Article XIII of the Constitution of the
State of California as appears from the certificates and affidavits
on file in the office of the City Clerk;
WHEREAS, said matter carne on regularly for hearing at the
time therein fixed; and
WHEREAS, all written protests and other written communications
were publicly read at said meeting, and all persons desiring to be
heard were fully heard;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That the project was instituted pursuant to said Resolution
of Preliminary Determination and of Intention No. 75-20 adopted
May 19, 1975, the diagram and the proposed boundaries were established
pursuant to Resolution No. 75-25, A Resolution Describing Proposed
Boundaries of Assessment District, Directing Filing of Boundary Map
and Assessment Diagram and the Recordation of Notice of Assessment,
adopted May 19, 1975, and the boundary map was filed in the office
of the County Recorder of Santa Clara County.

2. Protests were filed with the City of Gilroy during the
course of said hearing.
3. That the improvement project for the Chestnut Street-
Murray Avenue Improvement District, Project 1974-1, instituted pur-
suant to said Resolution of Preliminary Determination and of Intention
No. 75-20 adopted by this Council on May 19, 1975, be, and it is
hereby, ordered abandoned.
4. That the City Clerk of the City of Gilroy be, and she is
hereby, ordered to forward a certified copy of this Resolution to
the County Recorder of the County of Santa Clara, being the County
within which the proposed assessment district is located, with a
request that the County Recorder record said certified copy in the
official records of Santa Clara County and that the County Recorder
index said Resolution in the book containing the Index of Maps of
Assessments District.

copy of a Resolution of Abandonment of street improvement proceedings
instituted pursuant to A Resolution of Preliminary Determination and
of Intention adopted May 19, 1975, the map of the Assessment District
was filed with the CountyRecorderon

said Resolution of Abondonment was duly and regularly passed and adopted
by the City Council of the City of Gilroy at a regular meeting thereof
held on the 18th day of August, 1975, by the following vote:
AYES, and in favor thereof, Council members: CHILDERS, DeBEll, DUFFIN,
LINK, PATE, STOUT and GOODRICH.
