RESOLUTION NO. 1822
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REQUESTING
STATE LEGISLATORS AND THE LEAGUE OF CALIFORNIA CITIES TO FORMU-
LATE AND PRESENT LEGISLATION CURTAILING CERTAIN ENVIRONMENTAL
SUITS.
WHEREASJ the California State Legislature, in the Calif-
ornia Environmental Quality Act, has recognized the existence of dangers to
the environment and sought to protect the environment from spoilage; and
WHEREASJ many municipal projects are to provide improved
services and protection to local residents such as water supply, sewerage
service, street improvements, flood works, and park facilities; and
WHEREASJ obviously needed municipal improvements can be
delayed and the costs substantially increased through non affected individuals
or groups misuse of the true intent of the protection provisions under Environ-
mental Quality Act.
NOW THEREFORE BE IT RESOLVEDJ that the Council of the
City of Gilroy hereby urges its legislators and the League of California
Cities to endeavor to formulate amendments to the Act to provide exemptions
for obviously needed improvements and to further require an environmental
plaintiff to post a sufficient bond to fully compensate a successful public
agency defendant for damages incurred under a judgement in favor of the
defendant.
