RESOLUTION NO. 1823
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ESTABLISHING
THE ELIGIBLITY OF CERTAIN CLASSES TO RECEIVE TIME AND ONE HALF
OVERTIME~ THE EXEMPTION OF CERTAIN CLASSES AS DETERMINED BY THE
FAIR LABOR AND STANDARDS ACT AND THE ESTABLISHMENT OF STANDBY TIME
PROCEDURES FOR WATER AND SEWER PERSONNEL.
WHEREAS~ Federal regulations under the Fair Labor Standards
Act as amended requires municipal, county and state governments to
grant certain benefits to their employees, and;
WHEREAS~ the Fair Labor Standards Act in regard to those
qualified to receive time and one half overtime has been reviewed
and approved by the Gilroy Employees Association and the Personnel
Commission, and;
WHEREAS~ the Standby provisions for the Str-et and Sewer
Divisions has been reviewed and approved by the Gilroy Employees
Association and the Personnel Commission.
NOW~ THEREFORE~ BE IT RESOLVED that the following classifica-
tions are eligible to receive the minimum wage and time and a half
for overtime:

still applies to this group.)

Standby Time; the following procedures apply to the Streets
and Sewers Division to keep within the guidelines of the Fair Labor
and Standards Act:
1) An accurate accounting should be maintained for the actual time
a person works during the standby period. Time shall be recorded
to the nearest half-hour.
2) Employees on standby will earn 12 hours per weekend. If over 8
hours of services are required, additional overtime will be
earned at a rate of 1~ hours per additional hour worked. Holiday
standby will be earned at a rate of six (6) hours per day with
overtime earned if over four hours of services are required.
3) If the worker elects to not take off the standby or earned over-
time during the pay period in which it is earned, he will be paid
for it with his monthly earnings.
