Resolution 1842 ",(". .. !"! ., RESOLUTION NO, 1842 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REQUESTING THE STATE OF CALIFORNIA TO AMEND PARTICIPATING COSTS IN THE RE- CONSTRUCTION AND RESURFACING OF STATE ROUTE 101 (MONTEREY ROAD) U4-SC1-101, WHEREASJ the City of Gilroy did enter into an agreement(authorized by City Resolution No. 1828, dated July 1, 1974) with State for the reconstruc- tion and resurfacing the existing State Highway Route 101 (Monterey Road) in the City of Gilroy between First Street and Ninth Street; and WHEREAS} the above agreement provided for the maximum expenditure for State obligated work the amount of One Hundred and Fifty Thousand Dollars ($150,000.00) plus an additional maximum amount of ten (10) percent or Fifteen Thousand Dollars ($15,000.00) for contingencies both comprising a maximum total amount of One Hundred and Sixty Five Thousand Dollars ($165,000.00); and WHEREASJ the above agreement also provided for a payment to City for engineering and inspection services to be computed at fourteen percent (14%) of the aforesaid State's share of the construction costs; and WHEREAS} the City of Gilroy had a bid opening on July 26, 1974, for the above described works and City's planned "Safety and Beautification Project" work; and WHEREAS} the bid received was in the amount of Three Hundred and Four Thousand Seven Hundred and Sixty Two Dollars ($304,762.00) as compared to the City Engineer's and State's combined estimate for the combined work in the amount of Two Hundred and Sixty Thousand One Hundred and Twenty Nine Dollars and Ten Cents ($260,129.10); WHEREASJ the State's share of the project increased, in the amount of Thirty-Six Thousand Six Hundred and Seventy Dollars ($36,670.00); and WHEREASJ C'ity seriously questions that a more favorable bid would be obtained by re-bidding this project. RESOLUTION NO, 1842 -2- .., NOW} THEREFORE BE IT RESOLVED} that the Counci I of the City of Gilroy does hereby respectfully request the State of California (acting by and through its Business and Transportation Agency, Department of Transporta- tion) to agree to amend its agreement with the City of Gilroy, a municipal corporation, to increase its contribution (for its portion of the planned combined project) to the total amount of One Hundred Eighty Six Thousand Six Hundred and Seventy Dollars ($186,670.00) and to provide the additional amount of Fourteen Per Cent (14%) of the total amount directly above for the engine- ering and inspection services to be provided by the City of Gilroy.
