RESOLUTION NO. 1845
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
MODIFYING ON APPEAL RESOLUTION NO. 740 OF THE
PLANNING COMMISSION EXTENDING THE CONDITIONAL
USE PERMIT FOR MADONNA VILLAGE DAY CARE CENTER.
WHEREAS, MRS. S. FRASETTI has filed an appeal in due form
from Resolution No. 740 of the Planning Commission of the City of
Gilroy extending a conditional use permit so as to allow 12 non-
resident students for one year in the day care center located at
766 First Street in the City of Gilroy, and notice of the hearing
of said appeal has been given in the manner required by law and
the Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
September 3, 1974, at 8:00 p.m. in the Council Chambers in the
City Hall at 7390 Rosanna Street, Gilroy, California, and evidence
was submitted upon the said application and appeal from the findings
of the Planning Commission, the City Council finds:
(1) That the conditional use is not properly located as a
permanent facility in relation to the General Plan and to the
community as a whole and to other land uses and to transportation
and service facilities in the vicinity, and should be only a temporary
location; and
(2) That the conditional use, if it complies with all conditions
upon which approval is made contingent, and if additional access is
provided, will not adversely effect other property in the vicinity
or cause damage, hazard or nuisance to persons or property;
(3) That the extension of the conditional use by Planning
Commission Resolution No. 740 shall be subject to the following
conditions:
a) There shall be no extensions of the conditional use
at the present location beyond July 19, 1975.
b) The two locked gates between the day care center and .
First Street shall be opened so as to allow traffic circulation from
other than Miller Avenue.

WHEREAS, the Planning Commission did not err in granting the
extension of the use permit based on evidence presented at the
Planning Commission, the extension of the use permit is approved
as modified by the above conditions.
