I!~,' ~" . ~ .111 " RESOLUTION NO. 1853 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MODIFYING ON REQUEST FOR REHEARING CONDITION (b) OF ITS RESOLUTION NO, 1845, AND IN CONNECTION THEREWITH, REQUIRING THAT THE GATES INSTALLED AT THE l1ADONNA APARTMENTS CONTRARY TO THE PLANS APPROVED UNDER SECTION 49 OF THE ZONING ORDINANCE BE UNLOCKED AT ALL TIMES. . WHEREAS, MADONNA DEVELOPMENT CO" INC., HADONNA VILLAGE APARTMENTS and the l~~ONNA VILLAGE TENANTS ASSOCIATION have requested a rehearing on condition (b) of City Council Resolution No. 1845 requiring as a condition to the use permit of MADONNA VILLAGE DAY CARE CENTER that the locked gates between the day care center and First Street be opened; and WHEREAS, the request for rehearing was granted and has been held on October 7, 1974, at 8:00 p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California; and WHEREAS, in connection w~th said rehearing, the issue arose as to whether the fences and locked gates between the adult and family sections of MADONNA VILLAGE APARTMENTS were installed contrary to the plans therefore approved under Section 49 of the Zoning Ordinance; and WHEREAS, evidence was submitted on the issues, after due consideration, the City Council finds: (1) As to the use permit for MADONNA VILLAGE DAY CARE CENTER, condition (b) of Resolution 1845 shall be modified as follows: b) The two gates between the day care center and First Street shall both remain open at all times while the day care center is open so as to allow free circulation of traffic to First Street, (2) As to the Section 49 development of the MADONNA APART- MENTS, the fences and gates between the adult and family units were RESOLUTION NO. 1853 -1- , '.... o o . , f' -" installed contrary to plans filed therefore and approved by the Council, and for the safety of the residents in the event of fire or other emergency, the two gates shall remain unlocked at all times.
