RESOLUTION NO. 1713
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING WITH MODIFICATION THE APPEAL FROM RESOLUTION
NO. 649 OF THE PLANNING COMMISSION GRANTING A CONDI-
TIONAL USE PERMIT TO INTERNATIONAL CHRYSALIS, INC.
WHEREAS, FRANCIS CRAWFORD, on behalf of MR. AND MRS. JOE
AKINO has filed an appeal in due form from Resolution No. 649
of the Planning Commission of the City of Gilroy granting a
conditional use permit to operate theraputic rehabilitation
center located at 8065 Monterey Street in the City of Gilroy,
and notice of the hearing of said appeal has been given in the
manner required by law and the Zoning Ordinance of the City of
Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
February 20, 1973, at 8:00 p.m. in the Council Chambers in the
City Hall at 7390 Rosanna Street, Gilroy, California, and evidence
was submitted upon the said application and appeal from the findings
of the Planning Commission, the City Council finds:
(1) That the proposed use is properly located in relation
to the General Plan and to the community as a whole and to other
land used and to transportation and service facilities in the
vicinity as determined by the Planning Commission from substantial
evidence; and
(2) That the proposed use, if it complies with all conditions
upon which approval is made contingent, will not adversely affect
other property in the vicinity or cause damage, hazard or nuisance
to persons or property as determined by the Planning Commission
from substantial evidence; and
(3) That the conditions imposed by the Planning Commission
as to perimeter fencing and compliance with fire, building and
health codes should be complied with by March 15, 1973.
RESOLUTION NO. 1713

WHEREAS, the Planning Commission did not err in granting the
use permit based on evidence presented at the Planning Commission,
the appeal shall be and the same is hereby denied with the following
modification: Unless the conditions relating to fencing, landscaping
and compliance with fire, building and health codes are complied with
by March 15, 1973, this permit is hereby revoked.
