Resolution 1722 RESOLUTION NO. 1722 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING CRITERIA AND STANDARDS FOR THE DEVEWPMENT OF JUNK YARDS, SALVAGE YARDS AND WRECKING YARDS. WHEREAS, after study, the Planning Commission and staff has prepared and recommended adoption of the attached criteria and standards for the development of junk yards, salvage yards and wrecking yards in the City of Gilroy, and good cause appearing therefore, NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy approves the attached criteria and standards and adopts the same for the regulation of future junk yards, salvage yards and wrecking yards development in the City of Gilroy. YARnS AND AUTO HRECKING YARDS DEFINITION: ~~J~l'sL2r Salv~Jard Any lot or parcel of land that is used primarily for the storage of junk or salvaged material, including, but not limited to, scrap metal, wood, paper rags, or other scrap materials t or inoperable aut.omol:iiles or other vehi.cl.eto and equipment. . Junk yards, saivage yards and auto wrecking yards shall not be a permitted use unless and until the location of such use shall have been approved by the Planning Commission in the manner provided for in dealing with Con- ditional Use Permits (Section 71). Allowed in an M-2 or M-3 zone only. SITE DEVELOPMENT: Minimum Lot Size: A mininm.m lot area of one (1) acre and a maximum lot area of five (5) acrea shall be required for each site. Site Plan: A site plan shall be prepared and shall include surrounding property and the zoning thereof, landscaping and sprinkler systems, curbs, driveways, parking, buildings, property lines, center line and existing right of' way, topographical survey, building elevations, storm drainage, walls t fences, all locational and descriptive dimensions. Landscape Pl~:~ A detailed landscape plan shall be submitted showing location, size, and species of all proposed plant materials. 1andscap~ Adequate landscaping shall be established and maintained on all ~tes. The landscaping shall be designed so as not to obstruct necessary'site distance and traffic flow, shall offer adjacent properties a degree of """ visual and audio screening, and shall be of such quality as to enhance. ,,; the site, maintain the character and integrity of the neighborhood., and - promote excellence of developnent. Street Trees: Trees shall be planted and maintained in accordance with whatever street planting program may be available. Applicant should check with city jurisdiction for species, size and spacing. Driveway and Corner Planters: Such planters shall be required and planting material shall be low-growing, not over three feet (:3') in height, generally low-maintenance plant mater- ial which will not obstruct the view of drivers and customers. All other planters shall be located so as not to obstruct necessary sight distances or traffic flow. Bubbler Hose bibs Landscaped Curbs: All landscaped areas shall be separated from the Paved areas by a minimum of a four inch (4") concrete curb. . Fence~.L~va11~..D~9rativ_e_ Screen~: Materials, textures, colors and design of fences, walls and screening shall be compatible with the adjacent properties and the neighborhood. Solid Fencing shall be required on all sides of the yard itself a minimum of six feet (6') feet in height. Fences, walls or decorative screening with- in the first tvventy feet (20') of the street right of way line shall not be over three feet (3') in height. Location: No junk yard, salvage yard or auto wrecking yard shall be located within 660 feet of a highway or freeway that is raised more than five feet (5') above the ground level of the yard. Off-Street .fa.!'_~ All developments shall meet City off-street parking and maneuvering stan- dards, and shall insure the safe movement of vehicles and pedestrians. The arrangement of structures, driveuays, parking and landscaping shall be designed as to insure maneuvering ease, to serve the community, and to least adversely affect adjacent properties. TIle development shall provide five (5) spaces for each 2.5 acres or a portion thereof. Plus one (1) space for each employee on duty. All paved areas shall be asphalt or concrete. Access Driv~~~~~: Driveways shall be designed and located to insure a safe and efficient movement of traffic on and off the site from the lane of traffic nearest the curbs. On Site LightinR: No light source on the property shall be directly visible, or be of such intensity as to cause a traffic hazard or shine directly onto adjacent properties. SiRns: All signs shall be subject to the sign ordinance. FIRE PREVENTION REQUIREMENTS: Storage of Flammable Liquids: A permit from the City Fire Chief's office shall be required for storage of flammable liquids. All flammable liquids including waste oil, shall be stored underground. OPERATION: 1. No scrap metal, wood, paper, rags, or other scrap materials, or inoperable automobiles or other vehicles and equipment will be allowed outside of the fenced yards including garbage bins. 2. No material of any kind will be stacked higher than the fence surrounding the yard. 3. Outside area including landscaping shall be kept clean, neat and present a good appearance at all times. 4. Sale of Parts: If any wholesale or retail parts are sold on the premises, such sales shall be subject to all regulations pertaining to commercial activities. 5. Failure to comply with these regulations could result in Section 83.1 being applied and withdrawel of license to operate. - :3 - ~,
