Resolution 1733 ~~" RESOLUTION NO. 1733 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AND ADOPTING THE CITY CLERK'S CANVASS OF THE GENERAL MUNICIPAL ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY ON APRIL 10, 1973. RESOLVED, by the City Council of the City of Gilroy, California, that WHEREAS, by order of this Council a general municipal election was held and conducted in the City of Gilroy on Tuesday, the 10th day of April, 1973 as required by law and the Charter of said City; WHEREAS, it appears that notice of said election was duly and legal- ly given; voting precincts were properly establ ished; election officers were ap- pointed and election supplies furnished; and in all respects the election was held and conducted and the votes cast thereat received and canvassed, and the returns thereof made, determined and declared in time, form and manner as re- q~ired by the Charter of said City and the general laws of the State providing for and regulating municipal elections in said City; WHEREAS, the City Clerk of said City on the 13th day of April, 1973, in the Council Chambers in the Gi lroy City Hall, did conduct the canvass of the returns of said municipal election and did count the absentee ballots cast thereat, pursuant to direction and order of the City Council of said City; and WHEREAS, said cnavass was duly completed and the results thereof were certified by the City Clerk of the City of Gilroy and submitted to this Council. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows: 1. Said municipal election was held and conducted in the City of Gilroy, County of Santa Clara, State of California, on Tuesday, April 10,1973, in the time and in the form and manner as required by law. 2. That there were established six (6) voting precincts for the - 1 - RESOLUTION NO. 1733 ,7t"'~, - '*" ..."" purpose of holding said municipal election consisting of either regular election precincts established for holding state or county elections, or a consolidation of some or all of such precincts, as follows: CONSOLIDATED PRECINCT NO.1, comprising state and county precinct designated Precinct Number 3954 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO.2, comprising state and county precincts designated Precinct Numbers 3951 and 3953 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO.3, comprising state and county precincts designated Precinct Numbers 3966 and 3969 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO.4, comprising state and county precincts designated Precinct Numbers 3956 and 3968 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO.5, comprising state and county precincts designated Precinct Numbers 3960 and 3965 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO.6, comprising state and county precincts designated Precinct Numbers 3961 and 3963 as established by the Santa Clara County Board of Supervisors. 3. The canvass of the returns of the votes cast and the counting of absentee ballots cast in said City for the office of City Councilman and the Measure for the Charter Amendment was duly held on April 13, 1973, by the City Clerk of the City of Gilroy in accordance with the order of the Counci 1 and in accordance with law and said City Clerk has executed a certificate certifying to the results of such canvass, which certificate is hereto attached, marked Exhibit "All and by this reference is made a part hereof. Said certificate has been examined and is hereby approved and adopted by this Council as the official canvass - 2 - ~.<:#'* ',;i!;LiIV of said municipal election. 4. The whole number of votes cast in said City of Gilroy at said municipal election was 2,002 (including 33 absentee votes). 5. The names of the persons voted for, the offices for which they were voted, the number of votes received by each of said persons in each of said precincts and by absentee vote, together with the whole number of votes which they received in the entire city, are shown on said Exhibit "A", hereto attached. 6. At said general municipal election held in the City of Gilroy on April 10, 1973, the following persons were elected to the following offices: JOHN E. "JACK" PATE was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, April 17, 1973, and continuing until his respective succes- sor shall qualify. DENNIS L. DeBELL was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, April 17, 1973, and continuing until his respective successor shall qualify. GEORGE T. DUFFIN was elected a member of the City Counci 1 to hold office for a term of four years, from and after Tuesday, April 17, 1973, and continuing until his respective successor shall qualify. 7. The Charter Amendment voted for at the general municipal election, the number of votes received for and against said Charter Amendment in each of said precincts and by absentee vote, together with the whold number of votes which said Charter Amendment received in the entire City, is shown on said Ex- hibit "A" hereto attached. 8. That the Charter Amendment voted upon in said general municipal election is as follows: CHARTER AMENDMENT SUBMITTED TO VOTE OF VOTERS: "Shall Section 1400 of the Charter of the City of Gilroy be amended to provide that general municipal elections shall be held on the third Tuesday of April of each odd numbered year so as to permit consolidation of general municipal elections with school elec- tions?" - 3 - ...", ",,_ttfrf' 9. The total number of votes cast for the Charter Amendment voted upon was 1,680 and the total number of votes cast against the Charter Amendment voted upon was 110. 10. That at said election a maj9rity of all of the votes cast for and against the Charter Amendment were in favor thereof and Section 1400 of the Charter of the City shall be amended to read as follows: '~ection 1400. General Municipal Election,. A general municipal election shall be held on the third Tuesday of April of each odd numbered year, commencing with the year 1975, for the election of officers and for such other purposes as the Council may prescribe." 11. The City Clerk is hereby directed to make out and deliver to each of the persons elected a certificate of election signed by her and duly authenticated. She shall also impose the constitutional oath of office and have them subscribe thereto. 12. The City Clerk is hereby directed to obtain Legislative approval pursuant to Article XI, Section 3 of the Constitution of the State of California on the Charter Amendment. 13. That the City Clerk be, and she is hereby, instructed to enter this resolution in full in the minutes of this Council as a statement of the result of said general municipal election. Steinmetz, City Clerk of the City of Gilroy do hereby certify that, in accordance with the order of the City Council of the City of Gilroy, made on the 20th day of March 1967, by Resolution No. 1096 of said Council, which resolution refers to the General Municipal Election of April 11, 1967 and all subsequent municipal elections, pursuant to Section 22932.5 of the Elections Code, I did on the 13th day of April, 1973 in the Council Chambers in the City Hall, at No. 7390 Rosanna Street, Gilroy, California, duly and officially canvass the result of the General Municipal Election held in the City of Gilroy on April 10, 1973 and I do hereby certify further as follows: I, did canvass said returns, including absentee votes of said elec- tion, and found and ascertained that the total number of votes, including absen- tee votes, cast at said election was 2,002; that the number of votes cast in Precinct No.1 was 237; that the number of votes cast in Precinct No.2 was 430; that the number of votes cast in Precinct No.3 was 364; that the number of votes cast in Precinct No.4 was 307; that the number of votes cast in Precinct No.5 was 400; and that the number of votes cast in Precinct No.6 was 231; and That I did then also canvass the absentee ballots cast in said elec- tion and found and ascertained that the total number of absentee ballots issued for said election was 36; that all of said absentee ballots have been returned or received except two (2) and that the total number of absentee ballots cast at said election was 33; (one ballot challenged and not counted); and that the following named persons received the total number of votes set opposite their respective names for the respective office for which they were candidates, to wit: Total Vote excluding Absentee Vote Precincts: ~ "2" T "4" .~ "6" Absentee Vote FOR COUNCILMAN Fred p.
