RESOLUTION NO. 1758
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING THE APPEAL FROM RESOLUTION NO. 683 OF
THE PLANNING COMMISSION MODIFYING A CONDITIONAL
USE PERMIT FOR MADONNA VILLAGE DAY CARE CENTER
WHEREAS, MRS. S. FRASETTI has filed an appeal in due form
from Resolution No. 683 of the Planning Commission of the City of
Gilroy modifying a conditional use permit so as to allow 12 non-
resident students for one year in the day care center located at
766 First Street in the City of Gilroy, and notice of the hearing
of said appeal has been given in the manner required by law and
the Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
August 20, 1973, at 8:00 p.m. in the Council Chambers in the City
Hall at 7390 Rosanna Street, Gilroy, California, and evidence was
submitted upon the said application and appeal from the findings
of the Planning Commission, the City Council finds:
(1) That the modified use is properly located in relation
to the General Plan and to the community as a whole and to other
land used and to transportation and service facilities in the
vicinity as determined by the Planning Commission from substantial
evidence; and
(2) That the proposed use, if it complies with all condi-
tions upon which approval is made contingent, will not adversely
effect other property in the vicinity or cause damage, hazard or
nuisance to persons or property as determined by the Planning
Commission from substantial evidence;
WHEREAS, the Planning Commission did not err in granting
the modification to the use permit based on evidence presented at
the Planning Commission, the appeal shall be and the same is hereby
denied.
