Resolution 1644-A RESOLUTION NO. 1644 A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING THE NATIONAL ELEC- TRICAL CODE, 1971 EDITION, SUBJECT TO THE MODIFICATIONS AMENDMENTS. WHEREAS, Section 6.1 of the Gilroy City Code, as amended by Ordinance No. 871, provides that the latest edition of the National Electrical Code shall be submitted to the Counci 1 to become effective within the City upon approval by resolution, subject to possible modifications and amendments; and WHEREAS, the 1971 edition of said Code has been submitted together with modifications and amendments and concurred in by the City Engineer. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY DOES RESOLVE AS FOLLOWS: That the National Electrical Code, 1971 Edition, shall apply to con- struction of all kinds in the City of Gilroy subject to the modifications and amendments developed and recommended by the Gi lroy Building Department and itemized as follows: 1. PERMIT FEE The Electrical Code permit fee shall be calculated and establ ished as fifty per cent (50%) of the Building Code permit fee. I I. PENALTIES AND CODE VIOLATIONS If any contractor, sub-contractor, individual, or firm is found to be working without a permit where a permit is required, the follow- ing conditions shal I apply: 1. There shall be an automatic shut-down of the job. 2. No work shal I be permitted to commence unti 1 a permit has been issued. 3. Permittee shall be subject to a twenty-five dollar ($25.00) penalty plus a double permit fee. 4. Permit may not be issued within 48 hours of the stop work order. 5. No further inspection of any of the work shall be made until permits are in order. 6. The Senior Building Inspector shall have the right to issue a variance to 4 and 5 above should sufficient justification exist. RESOLUTION NO. 1644 A - 1 - <' I I I. COMMERCIAL AND INDUSTRIAL RACEWAYS In all commercial and industrial buildings, hotels, motels, and al I buildings in Fire Zones #1 and #2 shall be approved raceways "except flexible conduit" M.I. cable permitted. In all commercial and industrial buildings, receptacle outlets shall be installed on circuits that are separate from 1 ighting cir- cuits. All lights shall be wall switched. That a certified copy of this resolution be kept on file in the office of the City Engineer for examination by interested persons. That this resolution shall become effective thirty (30) days after its adopt i on.
