RESO LUT ION NO. 1550
A RESOLUTION OF THE CITY OF GILROY AMENDING SECTION 111, D OF THE
PERSONNEL RULES AND REGULATIONS ENTITLED "RESIDENCY REQUIREMENTSI'.
WHEREAS: the State of California in Senate Bi 11 1114, which when adopted
into law became Government Code, Sect ion 50083, states, "No Loca I Agency or
District shall require that its employees be residents of such Local Agency or
District", and
WHEREAS, the Attorney General did rule that Government Agencies could not
restrict non-citizens from employment, and
WHEREAS, the Gilroy Personnel Rules & Regulations in Section 111, D is
restrictive on said residency and citizenship, and
WHEREAS, the City Attorney suggested the said Rules and Regulations be
amended to conform to State Law, and
WHEREAS, the Personnel Commission did review and recommend to the City
Council for amendment of said section, and
WHEREAS, the City Council has reviewed said Personnel Commission recom-
mendation.
NOW THEREFORE BE IT RESOLVED: that Section 111, D of the City of Gi lroy
Personnel Rules & Regulations be amended to read:
D. RESIDENCY REQUIREMENTS:
Section 111, D.
Employees are encouraged to live within the corporate limits of
Gilroy so they can better respond to emergency situations that
may arise and so they can better share the community programs and
problems on a personal and family basis as well as a professional
basis.
