RESOLUTION NO. 1571
A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY EXPRESSING
OPPOSITION TO THE ENACTMENT OF SENATE BILL 333 BY THE LEGIS-
LATURE OF THE STATE OF CALIFORNIA
WHEREAS, Senate Bill 333 has been introduced in the Senate of the State
of California for the purpose of removing pol icemen and firemen from the pro-
visions of the meyers-Mi1 ias-Brown Act, Government Code Sections 3500, et seq.;
and
WHEREAS, said Senate Bill would impose upon cities compulsory and binding
arbitration of wages, hours and other conditions of employment for pol icemen
and firemen; and
WHEREAS, such compulsory arbitration by a third party not elected or
appointed within the framework of municipal government would constitute forced
and improper delegation by the Council of one of its responsibilities of govern-
ment, vested in it as the elected governing body of the city, and within the
realm of municipal affairs; and
WHEREAS, the Meyers-Milias-Brown Act, now in force, provides an effective
and binding procedure, within the framework of government, for meeting, conferring
and arriving at a mutually satisfactory agreement between government employers
and employees in the event of labor disputes; and
WHEREAS, the proposed legislation would descriminate unreasonably between
policemen and firemen and other government employees; and
WHEREAS, the benefits of the said Meyers-MiI ias-Brown Act are available
with respect to policemen and firemen and all other governmental employees with-
out regard to arbitrary classification or distinction;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY:
That the City of Gilroy is strongly opposed to the enactment of Senate
Bill 333 for the reasons hereinabove cited; and
BE IT FURTHER RESOLVED, that the City Clerk be and she is hereby directed
to send copies of this resolution to the appropriate state officials.
